Memorandum 1773   

In order to ascertain my right to the Tithe of about 130 acres of meadow &c commonly called tithe free ground because not known to have ever paid any. I caused the following qusetion [sic] to be proposed to Mr John Dunning a Gentleman of ye first Eminence in D Law and late Solicitor General

Qe. Whether if lands have never paid Tithe within the memory of man. & no other plea is alleged to found an Exemption upon, such lands shall be adjudged tithe free:

Answer. Tithes are due of common Right & it is no answer to a demand of Tithe that the lands in respect of which it is demanded are not known to have ever paid any unless some ground of Exemption can be shown.

In consequence of which opinion my joint Tenants John Tayler, John Cowley & Charles Hore did by my Order this year 1773 take the tithe of the aforesaid ground when no one thought proper to contest the same.

This year 1775 a meeting was held at L. Brickhill to consider an application to Parliament for an act to inclose this Parish When the Rector demanded a Sixth of all the new Inclosure and a ninth of the old: to which Thomas Cook Esq. principal Proprietor consented. But it not meeting with the approbation of some other proprietors. the affair was dropped.

NB: The black ground upon the heath to be left out of the inclosure for fuel for the poor as usual
