John Tooth 1766

This is the Last Will and Testament of me John Tooth of Castlethorpe in the County of Buckingham. Yeoman made the twenty seventh day of May in the fifth Year of the Reign of our Sovereign Lord George the third by the Grace of God of Great Britain ffrance and Ireland King Defender of the Faith and So forth and in the Year of our Lord Our one thousand seven hundred and sixty five First I Will and Order and direct that all my Debts Legacies and funeral Expences be fully paid and discharged Next I give and devise unto my Sons and Daughters John Tooth of Sherrington in the County aforesaid Yeoman, Charles Tooth of Castlethorpe aforesaid Yeoman Ann Tooth of Castlethorpe aforesaid Widow of my Son Samuel Tooth deceased Anne Panter (the Wife of Richard Panter now or late of Castlethorpe aforesaid Yeoman) and Jane Wheatley (the Wife of Joseph Wheatley of Hanslope in the County aforesaid Wheelwright) All those my three Cottages or Tenements with the Appurtenances thereunto belonging Situate lying and being in Castlethorpe aforesaid and now in the several Occupations of Andrew Meadows Esther Newberry and Sarah Smith or their Assigns To hold the said three Cottages or Tenements Hereditaments and Premises with their Appurtenances unto the said John Tooth, Charles Tooth Anne Tooth Anne Panter and Jane Wheatley their Heirs and Assigns for ever As Tenants in Common and not as Joint Tenants Also I give and devise to my said Daughter Anne Panter All that my Messuage Tenement or Farm House with the Barns Stables Yard and Garden and other the Appurtenances thereunto belonging Situate at Castlethorpe aforesaid and now or late in the Occupation of the said Richard Panter or his Assigns To hold the said Messuage Tenement or Farm House Hereditaments and Premises with their and every of their Appurtenances unto my said Daughter Anne Panter and her Assigns To the only Sole proper Use and behoof of the said Anne Panter and her Assigns forever Subject nevertheless to the Payment of the sum of fforty Pounds immediately after my Decease by the said Anne Panter to the Persons herein after mentioned Also I give and devise to my Daughter in Law Elizabeth Wilden and her Assigns for and during the term of her natural Life All that my Cottage or Tenement with the Appurtenances thereto belonging Situate and being in Castlethorpe aforesaid and now in the Occupation of William Rainbow or his Assigns And from and after her Decease Then I give and devise the said last mentioned Cottage or Tenement and Premises with its Appurtenances unto the said John Tooth, Charles Tooth, Anne Tooth, Anne Panter and Jane Wheatley their Heirs and Assigns for ever As Tenants in Common and not as Joint Tenants Also I give and bequeath to the said John Tooth, Charles Tooth, Anne Tooth, Anne Panter and Jane Wheatley the Sum of Forty Pounds of good and lawful money of Great Britain to be divided amongst them share and share alike immediately after my my decease out of the said Messuage Tenement or Farm House and Premises herein before devised to my said Daughter Ann Panter Also I give and bequeath to my said Daughter in Law Elizabeth Wilden the sum of ten Pounds of like lawful Money of Great Britain to be paid her by my Executors herein after named within six Months next after my Decease And Lastly all the rest residue and Remainder of my Goods Chattells Cattle Stock of Corn Grain Hay and Utensils of Husbandry and Personal Estate of what Nature sort or kind soever and wheresoever (after all my said Debts and Funeral Expences are fully paid and discharged) I give and bequeath to the said John Tooth, Charles Tooth, Anne Tooth, Anne Panter and Jane Wheatley to be equally divided between them share and share alike And in case either or any of them shall make any Disturbance or Refusal to Accept of their Legacies or his her or their Share of my said Personal Estate so by me given and bequeathed to him her or them as aforesaid Then and in such case I will order and direct that the Legacy Interest and Share of the residue of my said Personal Estate of him her or them or any of them so refusing to comply with this my Will shall be Absolutely null and void to all Intents and Purposes whatsoever And I do hereby make ordain constitute and appoint John Truelove of Castlethorpe aforesaid Laceman and Thomas Walker of the same place Land Surveyor to be Executors of this my last Will and Testament hereby revoking all former and other Wills by me at any time heretofore made and declare this only to be my last Will and Testament In Witness whereof I have hereunto set my hand and seal the day and Year first above written John Tooth Signed Sealed Published and Declared by the said Testator as and for his last Will and Testament in the Presence of Us who have hereunto Subscribed our Names as Witnesses thereto in his presence and in the presence of each other Elizabeth Johnson of Castlethorpe Bucks Ann Martin of the same place Thomas Harris of Western Flavil Northamptonshire

A Codicil to be Annexed to and made part of the last Will of John Tooth of Castle Thrupp in the County of Bucks Yeoman Whereas I have by my Will devised to my Daughter Anne Panter All that Messuage or Tenement with the Barns Stables Outhouses Gardens and Appurtenances in Castle Thrupp aforesaid late in the Occupation of Richard Panter charged with the sum of Forty Pounds as therein mentioned Now I give and devise the same Premises charged as aforesaid to my said Daughter Anne Panter her Heirs and Assigns for ever And whereas I have devised and bequeathed to my Daughter Elizabeth a Cottage in Castle Thrupp during her life And also ten pounds by the Name of Elizabeth Wilden Now I ratify the said Devise and Legacy to her my said Daughter Elizabeth Wilden whether her Name be Elizabeth Wilden or Elizabeth Brooks In Witness whereof I the said John Tooth have hereunto set my hand and seal the Eleventh day of September One thousand seven hundred and sixty five John Tooth his Mark Signed Sealed and delivered by the said John Tooth as a Codicil to his last Will in the presence of us who have Subscribed our Names as Witnesses at his request in his presence and of each other Edw: Bloxham John Hone Thomas Trulove

Proved the 17th day of June 1766 before the Reverend Moses Agar Clerk Surrogate by the Oath of John Truelove one of the Executors to whom Administration was Committed he being first sworn duly to Administer (the other Executors reserved)
