Arthur Capes 1845
Know all men by these present that we Joseph Goodman of Bradden in the county of Northampton yeoman John Goodman of Towcester in the same county gentleman and John Middleton Vernon of Towcester aforesaid wine merchant are held and firmly bound unto The right reverand Father in God George by devine permission Lord Bishop of Peterborough in the sum of forty pounds of good and lawful money of Great Britain to be paid unto the said Lord Bishop or his certain Attorney executor administrators or assigns to which payment is to be well and truly made We oblige ourselves and each of us by himself for the whole our and each and every of our heirs executors and administrators firmly by these present Sealed with our seals Dated the seventeenth day of June in the year of the reign of our soverign Lady Victoria by the grace of god of the United Kingdom of Great Britain and Ireland Queen Defender of the faith and in the year of our Lord One thousand eight hundred and forty five.
Whereas by an Indenture bearing date the ninth day of march one thousand seven hundred and sixty five and made between Thomas Robinson and Margaret his wife of the one part and Reuben Capes of the other part the said Thomas Robinson and Margaret his wife in consideration of the sum of two hundred pounds paid to them by the said Reuben Capes did grant and demise unto the said Reuben Capes all that messuage tenement or Inn commonly called or known by the name or sign of the Rein Deer then in the occupation of Thomas Betts alias Franklin Also all that close of pasture ground containing by estimation four acres (more or less) commonly called or known by the name of Culvers Close adjoining on the King's Highway (which said premises are situate and lying in Potterspury in the said county of Northampton and which said messuage was then lately erected by Thomas Herne upon part of the aforesaid Close called Culver's Close) Together with the appurtenances to hold the same unto the said Reuben Capes his executors administrators and assigns for the term of five hundred years subject nevertheless to a proviso for redemption of the same hereitaments and premise on payment by the said Thomas Robinson and Margaret his wife or either of them there or either of their heirs executors administrators or assigns unto the said Reuben Capes his executors administrators or assigns of the sum of two hundred and four pounds on the ninth day of September then next And Whereas by an Indenture bearing date the fourteenth day of March one thousand eight hundred and nine and made between John Scrivener of the first part Joseph Scrivener of the second part and Richard Gardener of the third part in consideration of two hundred and fifty pounds to the said John Scrivener paid by the said Richard Gardener and of ten shillings to the said Joseph Scrivener paid by the said Richard Gardener the said Joseph Scrivener did bargain sell and demise unto the said Richard Gardener his executors administrators and assigns All that the said messuage tenement or Inn situate in Potterspury aforesaid called the Rein Deer then in the occupation of Thomas Kingston and also that Brewhouse and those four stables and yard thereto adjoining and belonging and also all that part of the garden lying next to the said messuage and Brewhouse on the north and side thereof extending thence fifteen feet and four inches and also that foot path over and across the yard and Close of the said Reuben Winters in manner therein described and other the appurtenances thereunto belonging To hold the same unto the said Richard Gardner his executors administrators and assigns for the term of one thousand years subject nevertheless to a proviso for redemption of all the said hereditaments and premises on payment by the said John Scrivener his heirs executors administrators or assigns unto the said Richard Gardner his executors administrators or assigns of two hundred and fifty pounds with Interest on the fourth day of September then next And whereas by divers means Assignments and other acts and assurances in the law and ultimately by an Indenture bearing date the twenty fourth day of June one thousand eight hundred and forty one made between Sarah Gurney and John Gurney of the first part John Webb of the second part Thomas Scrivener of the third part William Druce of the fourth part Henry King of the fifth part Elizabeth Stenson now of the town of Northampton in the said county spinster of the sixth part Arthur Capes therein described as then of Potterspury aforesaid Wine Merchant of the seventh part and Thomas Day of the eighth part All such and so many and such part and parts of the said messuage tenement Inn and other hereditaments and premises as were comprised in or affected by the said term of five hundred years created by the said Indenture of the ninth day of March one thousand seven hundred and sixty five and one thousand years created by the said Indenture of the fourteenth day of March one thousand eight hundred and nine respectively were for the consideration therein mentioned assigned and became vested in the said Arthur capes his executors administrators and assigns for all the residue of the said term of five hundred years and one thousand years therein to come and unexpired In trust of the said Elizabeth Stenson her heirs and assigns and to attend the inheritance And Whereof by divers Conveyances Wills and other good and sufficient assurances in the Law and particularly by an Indenture of release bearing date the said twenty fourth day of June one thousand eight hundred and forty one and made between the said Henry King of the one part and the said Elizabeth Henson of the other part she the said Elizabeth Henson is now become entitled to the freehold and inheritance of the said hereitaments and premises and hath also the sole equitable right title and interest of in and to the said premises which were so as aforesaid granted demised and assigned in and by the herein before part recited Indenture with the appurtenances And Whereas the said Arthur Capes departed this life on the twenty fifth day of March one thousand eight hundred and forty four intestate and without having made any assignment of the said premises or the then residue of the said two several terms of five hundred and one thousand years therein respectively and no legal personal representative of the said Arthur Capes deceased can now be found and therefore the said Elizabeth Stenson is unable to make a complete legal Title to the same premises for want of a personal representative of the said Arthur Capes deceased And she is desirous that Letters of Administration of the goods chattels and credits of the said Arthur Capes deceased may be committed and granted to me the within bounden Joseph Goodman limited only for the purpose of assigning the residue and reminder of the said several terms of five hundred years and one thousand years respectively to as aforesaid vested in the said Arthur Capes deceased and so far only as affects the said hereitaments and premises which so as aforesaid are now vested in the said Elizabeth Stenson to some person or persons In trust to attend upon the reversion and inheritance thereof for the purpose of protecting the same from me[s]ne incumbrances
Now therefore the Condition of the within written Obligation is such that if the within bounder Joseph Goodman do well and truly administer and faithfully dispose or the goods chattels and credits of the said Arthur Capes deceased limited so far as concerns all the right title and interest of him the said Arthur Capes deceased in and to the said premises so as aforesaid rested in the said Elizabeth Stenson and the residue and remainder of the said several term of five hundred years and one thousand years respectively therein now to come and unexpired and all benefit and advantage to be had received and taken therefrom but no further or otherwise or in any other manner whatsoever and do make or cause to be made a true and perfect Inventory of the goods chattels and credits of the said Arthur Capes deceased limited as aforesaid and exhibit the same into the Registry of the Consistory Court of Peterborough together with a true and just account of and concerning his aid Administration when he shall be thereunto lawfully required Then the within written Obligation to be void and of none effect or else to remain in full force and virtue
