John Austin 1765

This is the last Will and Testament of Mr. John Austin of Grafton Regis in the county of Northampton clerk I resign my soul to Almighty God in humble hopes of my forgivness of all my transgressions through the Mediation of my Blessed redeemer I give my Brother Isaac Austin my own and my sons picture I give to my Sister Sarah Winchcombe one hundred pounds I give to my Brother Thomas Austin and Isaac Austin one hundred pounds each and I likewise give to them the said Thomas Austin and Isaac Austin the interest as may be due to me on their Bond to meat my decease I give to Mr. John Eccles Rector of Stoke Brurene and Samuel Hare Rector of Beachampton the sum of two hundred pounds In Trust that they the said John Eccles and Samuel Hare and the Survivor and the Executors or Administrators of such Survivor pay the Interest thereof to Elizabeth Drake the widow of my kinsman Christopher Drake deceased during her life if she continues his widow and at her decease or Marriage I give the same to be equally divided amongst the Children of the said Christopher Drake as shall be living at her decease or Marriage I likewise give to the said John Eccles and Samuel Hare all the remainder of my Personal Estate of what nature soever or wheresoever In Trust that they the said John Eccles and Samuel Hare and that the Survivor and the Executors or Administrators of such survivor apply the same for the use benefit advantage and Maintenance of the said Elizabeth Drake and her children aforesaid in such manner as they the said John Eccles and Samuel Hare or the Survivor or Executors or Administrators of such Survivor shall Judge proper but incase the said Elizabeth Drake shall marry again then on her Marriage I revoke and make void all and every such Legarcys and Interest I have before given her and I give the same entirely for the benefit and Maintenance of the children of the said Christopher Drake and my Will is that the said John Eccles and Samuel Hare to themselves all such Expenses they shall sustain in the Execution of this Trust nor be answerable each for the other but each for his own Act and receipt only and I constitute the said John Eccles and Samuel Hare Executors of this my Will hereby revoking all former Wills In Witness whereof I the said John Austin have to this sheet set my hand and to this last my hand and seal this Seventh day of May One thousand and seven hundred sixtytwo John Austin Signed Sealed Published and declared by the said Testator as his last Will in the presence of us who have attested the same in his presence and of each other Edw Bloxham John Warr

This Will was proved at London on the twenty third day of April in the year of our Lord One thousand seven hundred and sixtyfive before the Right Worshipfull George Lay Doctor of Laws Master Keeper or Commisionary of the Prorogative Court of Canterbury Lawfully Constituted by the Oaths of John Eccles and Samuel Hare the Executors named in the said Will to whom Administration was granted of all and Singular the Goods Chattles and Credits of the said deceased they having been first sworn by Commission duly to Administer
