John Kerbye 1573

In the name of God Amen the 4th. Day of May in the year of our Lord God one thousand five hundred seventy three I John Kerbye the elder of Grafton Regis within the county of Northampton; yeoman being sick in body but of good and perfect mind and memory the thanks therefore be given unto Almighty God do ordain and make this my last Will and Testament in manner and form following First I bequeath my soul to Almighty God my maker Saviour and redeemer in whom and by the merits of whose blessed passion is all my trust of free remission and clear forgiveness of all my sins and my body to be buried within the parish church of Grafton Regis aforesaid when it shall please God that I shall depart this transitory world. Item I do give unto the mother church of Peterborough 12d Item I do give to and amongst the poor people inhabiting in Hardingstone 20s Item I do give to the poor in Kingswell Lane in Northampton 3s 4d Item I give towards the repairing of the church in Grafton aforesaid 20s Item I give to the amending the highways vidz. Grafton Lane and the cause ways there 10s Item I give to amending of Alderton highways vidz. between Grafton Lane and Twyford Bridge 10s Item I give to Agnes Spencer of Yardleye Gubbyon 3s 4d Item I give to every one of my godchildren one sheep a piece called a hogrell Item I give to Henry Kirbye my brother's son twenty sheep which went at Sewell and now going in the pastures of Grafton and if they do lack of the said number by any casualty then to be made up with other sheep of like value Item I give to Emerye Framklyne my maid one heiffer bullock of two years Item I give unto Robert Seywell my servant £10 Item I give to every of the rest of my servants before not named one sheep a piece Item I give to the children of my son John Kirbye all my sheep now going within Seweardsleye and Thickeshawe which be about the number of 25 score sheep together with all my whole estate and interest in the same grounds aforenamed to be occupied and employed by the said John Kirbye to the use of his said children Item I do give unto my said son John Kirbye the £25 which Mr George Fermor owe me and all other things of mine which be now in the possession of the said John Kirbye my son Item I do give unto the same John Kirbye my son five pieces of timber in my yard to taken at his choice Item my will is for and in consideration of my said gifts to my said son John Kirbye he shall pay or cause to be paid to Robert Lye of Northampton shoemaker £10 of lawful money of England to the use of the[m] his children within half year next after my decease Item I give unto the said Robert Lye one piece of timber in my yard Item I do give unto Samulyell Pye butcher of London my gelding used for my own saddle Item I give to my son Robert Kirbye to the use of his three children £60 of lawful money of England to be paid them out of my stock of cattle within the pastures of Grafton equally to be distributed amongst them and if it shall please God to call any of the said children forth of this world before the age of twenty years that then my will is the survivor or survivors of them shall have and enjoy his portion so deceased Item I give to my said son Robert Kirbye all my sheep horses mares geldings and colts in pastures of Grafton aforesaid except and reserving one black gelding of the age of two years which I give to William Walleye parson of Syrshame Item I give to my said son Robert Kirbye all my beast bullocks and calves in the same pastures and at home except and reserving ten kiene one bull and four heifers which I give unto Izabell my wife to be taken at her choice also I give unto my said son Robert Kirbye one lease with my whole right intent and title of and in one meadow ground with the appurtenances lying and being within the parish of Passenhame within the county of Northampton called the great hame also I do give unto the same Robert Kirbye my son diverse debts to me due by sundry persons here under written namely following that is to say First of all Samulyell Pye butcher of London £29 7s of Francis Russell of Towcester £25 of Mr William Hickillings of Grenesnorton £10 of Hollingworthe one of the workmen in Graftone £10 of Henry Ins fine butch £3 of Thomas Meade of Seweardsleye 54s 4d of John Travell of Roade £6 of John Butcher of Pawlesburye £3 of George Fearne of Shrobbe gent £50 of William Hockwell of Hulcote 37s 4d of Richard Jones of the same town £4 6s 8d of Thomas Fowcks of Shittlehanger 26s 8d of William Seywell of Grafton 26s 8d of John Harris gent £10 of Richarde Richardsone of Grafton aforesaid 43s 4d of Richarde Ives of Alderton 26s 8d of Mulshooe 10s of Peter Vincente gent 20s of Samwell 5s of William Speareman of Hartwell 20s of the Lord vauxe of Harrowden 44s of Mr Watsonne the elder of Rockingham £8 of Thomas Brooke of Okeleye Magna esquire £20 of John Cowper of Assheton 10s of widow Fletcher of Slapton 43s 4d of Christopher Binckes of Hanslappe 13s 4d of Jherome Odell of Yardley Gobione 26s 8d Item my will is that my said son Robert shall pay or cause to be paid forth of the said goods chattels and debts before to him namely given in this my will and testament these persons namely following vidz to John Rawlens son to Henry Rawlens of Hanslappe £10 and to the other 6 of the said Henrie Rawlens his children to everyone of them £5 and if it shall please God to call any of the said children forth of this world before the age of 20 years then my will is that the portion of any of them so deceasing shall remain to the survivors or survivor of the same children equally to be parted amongst them the same several sums last recited to be paid within one year next after my decease Item my will is that my said son Robert Kirbye shall further pay or cause to be paid to John Whalleye of Graftone aforesaid £40 to be paid within one year next after my decease unto John Seywell late my servant £5 14s and unto Izabell Seywell £5 being sister to the said John Seywell Item my will is that my said son Robert Kirbye shall pay or cause to be paid forth of the said goods chattels and debts to him before given in and by this my will and testament here after recited that is to say to his own three children before mentioned their legacies to the poor to the ammending the highways their portions and to Margarette Grace and Jone Coole of Graftone to either of them 5s to the repairing of the church of Graftone and to my godchildren to Henrie Kirbye and Emerye Franklyne to Robert Seywell to my servant Henrie Rawlins his children to John Whalleye and John Seywell and to Isabell Seywell their portions before named Item I do give and bequeath unto my late brother John Kirbye his children that is to say Edward Kirbye Agnes Kerbye Johanne Kerbye and Elizabeth Kerbye to everyone of them four killing lambs to delivered within one half year next after my decease Item I will that my executrix hereinafter named in this my Testament shall not take to her use the messuage or farm in Grafton aforesaid wherein Henrie Lumbarde now dwells but only to the use of my late brother's children successively from the eldest son to the youngest child so that they be not at the charges for obtaining of the same The residue of all my goods chattels and debts my debts being paid and my legacies in this my Testament performed and fulfilled and my funerals discharged I do wholly give them unto Isabell my wife whom I ordain and make my full and sole executrix of this my last Will and Testament and John Kerbye my son and Henrie Rawlens of Hansloppe my overseers to see the same performed unto whom I give 6s 4d to either of them for their pains taking in that behalf their being witness Henrie Lumbarde Firmyn Russell and William Savaige this writer with others the mark of Henrie Lumbarde
