This is the last Will and Testament of me
James Greaves of
Haversham in the County of Buckingham Gentleman First I will order and direct that all my just debts and funeral and testamentary expenses shall be fully paid and satisfied I give and bequeath unto my dear wife
Ann Greaves such part or parts of my household goods and furniture plate linen and China as she shall select not exceeding in value the Sum of eighty pounds two and for her own absolute use and benefit and I give and bequeath all and every my messuages lands tenements hereditaments and Real Estate situate at
Bradwin and
Abthorpe in the County of Northampton unto my dear Son
Alexander Greaves his heirs and assigns for ever and I give and devise all and every my messuages lands tenements titles hereditaments and real Estate situate at
Haversham aforesaid and I also all that annuity of two hundred and ten pounds chargeable upon and issuing out of certain other hereditaments in
Haversham aforesaid limited to and now invested in me by way of industry against the rent charges of one hundred and ninety five pounds payable to the Rector of
Haversham aforesaid for the time being in lieu of titles unto and to the use of my dear son
William Greaves his heirs and assigns for ever subject nevertheless and I do hereby charge and make chargeable the same as here in after mentioned (that is to say) two and with the other occupation by my said Wife
Ann Greaves of two rooms one sitting room and one bedroom in the Messuage tenement or dwelling house now in my occupation at Haversham aforesaid for and during the term of her natural life for so long as she shall think fit to reside in and occupy the same and also and with the payment of the several annuities or yearly sums next hereinafter mentioned (that is to say) one annuity or yearly Sum of one hundred pounds to my said Wife
Ann Greaves and during the time of her natural life one annuity or yearly Sum of twenty five pounds to my Dear Son
Richard Greaves for and during the term of his natural life one annuity or yearly Sum of twenty five pounds to my dear Son
Alexander Greaves for and during the term of his natural life one annuity or yearly Sum of ten pounds to my dear daughter
Mary Greaves for and during the term of her natural life one annuity or yearly Sum of ten pounds to my dear daughter
Sarah Greaves for and during the term of her natural life and one annuity or yearly sum of ten pounds to my dear daughter
Celia Phillips for and during the term of her natural life and I direct that the said annuities respectively shall be paid by two equal half yearly payments on the twenty fifth day of March and the twenty nineth day of September in every year during which the said annuities respectively shall be payable the first payment there are of respectively to be made on the first of the said days which shall happen next after my decease Provided always and I do hereby direct that in case any half yearly payment of any of the said several annuities or any part thereof respectively shall be in arrears and unpaid for the space of thirty days next after any or either of the said days whereon the same news ought to be paid as aforesaid the same being first lawfully demanded then it shall and may be lawful to and for the person whose annuity shall be so in arrears as aforesaid or the executors or administrators of such person of then deceased or illeg the person or persons entitled to the annuity so in arrears as aforesaid in two and upon the real Estate charged there we hath or liable to the payment thereof or any part there of to enter and distrain for the same and the distress and distresses then and there are found to detain and keep until all such arrears and all costs charges and damages and expenses attaining the making and keeping such distress or distresses shall have been fully paid and satisfied and in default of payment thereof respectively or any part thereof respectively for in due time after such distress or distresses shall be so taken to appraise sell and dispose thereof or otherwise to act therein accordingly to law for in like manner as in cases of distress made or taken for arrears of rent ….ed upon, and leases and further that in case no sufficient distress can be found on the said real Estate or any part thereof then it shall be lawful for the illeg to the annuity so in arrears as aforesaid unto and upon the said real estate or any part thereof and to illeg and take the rents and profits thereof for his or her own use and benefit or until thereby or therewith all such arrears and also all payments of such annuity which shall become during the time such person shall in receipt of the rents and profits as aforesaid and all costs and charges incurred by or occasioned to such person by reason or on account thereof shall be fully paid and satisfied and I give and bequeath to all and every my Farming Stock for the Crops effects and any other personal Estate and Effects whatsoever and wheresoever not hereinbefore disposed of subject to the payment of all my just debts and funeral and testamentary expenses unto my said Son
William Greaves two and for his own absolute use and benefit And I give and devise all Estates of or two which are a shall at the time of my decease be seized or entitled upon trust or by way of mortgage unto and to the use of my said Son
Richard Greaves and
William Greaves their heirs and assigns for ever upon and subject to the trusts and equity of redemption affating the same respectively And I nominate constitute and appoint my said Sons
Richard Greaves and
William Greaves executors of this my last Will and Testament In Testimony whereof I the said James Greaves the Testator have to the first two sheets of this my last Will and Testament contained in the sheets of paper set my hand and to this third and last sheet thereof my hand and seal this tenth day of January in the year of our Lord one thousand eight hundred the and thirty nine
James Greeves the Testator as and for his last Will and Testament in the presence of us whom in his presents at his request and in the presence of each other have here unto subscribed our names as witnesses ( the interlineation between the seventeenth and eighteenth lines of the second sheet opposite to which the said Testator
