This is the last Will and Testament of me Thomas Greaves of Haversham in the County of Buckingham Gentleman being of sound and disposing Mind Memory and understanding First I will order and direct that all my just debts funeral and testamentary Expences shall be fully paid and satisfied And after Payment thereof I give devise and bequeath unto the Reverend William Godfrey of Ravenstone in the said County of Buckingham Clerk and William Greaves of Wicken in the County of Northampton Gentleman their Heirs Executors and Administrators All and every my Manors Messuages farm Lands Tenements hereditaments real Estate parts shares and Moieties thereof respectively whereof or wherein I am seised of an Estate in fee simple of inheritance and whether in possession reversion remainder or expectancy situate at Haversham aforesaid Abthorpe in the said County of Northampton or elsewhere ( save and except a certain Messuage or Tenement at Haversham aforesaid now in the Tenure or occupation of Sarah Dampier Widow hereinafter by me otherwise devised) And also all and singular My household goods and furniture Plate linen and China ready Monies, Monies in the funds, Bonds, Bills, Notes, and other Securities for Money, live and dead farming Stock, Crops, Hay, Implements of husbandry, Chattels, and Effects whatsoever and wheresoever, of whatever nature kind or sort soever, the same may be To hold my said real and personal Estates respectively according to their several and respective natures and qualities (save out of my said real Estate as aforesaid) unto the said William Godfrey and William Greaves their Heirs Executors Administrators Upon Trust that they the said William Godfrey and William Greaves or the Survivor of them or the Heirs Executors or Administrators of such Survivor do and shall as soon as conveniently may be after my decease sell and absolutely dispose of such my said real Estate together with such part of my said personal Estate as shall not consist of Monies and debts either by public Auction or private Contract at one or more Time or Times and for the best price or prices that can or may be reasonably had or gotten for the same And do and shall collect and get in all such debts as shall be due and owing to me at the Time of my decease And for facilitating such Sale or Sales of my said real Estate as aforesaid I do hereby direct and declare that the receipt or receipts of my said Trustees or the Survivor of them or the Heirs of such Survivor shall be a good and sufficient discharge to the purchaser or purchasers of my said real Estate for so much Money as shall be thereby acknowledged to be received And that after such receipt or receipts given such purchase or purchases or his or their Heirs Executors Administrators or Assigns shall not be answerable or accountable for the same or for any part thereof or for any loss misapplication or nonapplication thereof or be anywise implicated in the Trust of this my Will And as to the purchase Monies to arise by Sale or Sales of such my said real and personal Estates so directed to be sold as aforesaid together with all other my personal Estate Monies and premises aforesaid after Payment of all my just debts funeral and testamentary Expences I direct my said Trustees and the Survivor of them and the Executors and administrators of such survivor to invest the same in the Government Stocks or Fund of Great Britain or upon real Security or Securities in England at Interest in their or his Names or Name and do and shall vary alter and transpose such Stocks funds or securities for others of the like Nature as they or he in their or his discretion shall deem expedient and stand possessed of and interested in the same stocks funds or securities respectively Upon the Trusts and to and for the Ends intents and purposes hereinafter by me expressed and declared of and concerning the same that is to say Upon Trust to pay out of the Interest dividends and yearly proceeds of the said Stocks funds or securities as received unto my dear Wife Susanna Greaves the sum of Fifty Pounds a Year for and during the Term of her Natural life provided she shall remain my Widow to and for her separate use and benefit and which said sum of Fifty Pounds per annum I give to my said Wife in full recompence and satisfaction of any claim she might have at common Law to dower and thirds in or out of my said real and personal Estates And as to the residue and remainder of the interest Dividends Funds and securities aforesaid Upon Trust to pay and apply the same for and towards the Maintenance Support Education bringing up and advancement in the World of all and every My several children who may be living at my decease or born in due Time afterwards until they shall severally and respectively attain their Ages of twenty one Years And when and as they shall severally and respectively attain that Age Upon Trust to pay and divide the said Stocks funds and Securities (after setting apart such part thereof as will produce the said annuity hereinbefore by me directed to be paid to my Wife for life or during her Widowhood as aforesaid provided she shall be then living) unto and equally amongst them my said children in equal shares and proportions as Tenants in Common To Whom I give and bequeath the same accordingly the shares and share of such of them him or her who shall die under the said Age of twenty one years leaving lawful Issue to be paid and payable to such issue on their his or her attaining the said Age of twenty one years And in the mean Time to be held by my said Trustees or Trustee in Manner aforesaid and applied towards their education support and advancement as aforesaid during such their his or her Minorities or Minority but in the event of any or either of my said children departing this life under the said Age of twenty one years without leaving lawful issue then I direct the shares or share of them him or her so dying as aforesaid to be paid at the Time and in Manner aforesaid to the Survivors or Survivor or others or other of them Provided Always and I do hereby declare that it shall and may be lawful to and for My said Trustees and the Survivor of them and the Executors and Administrators of such survivor at their or his discretion to call in and receive any part of the portion or portions of any such Child or children or his her or their issue payable to him her or them under this my Will out of the said stocks funds or securities not exceeding in the whole one third part of such portion or portions respectively towards the apprenticing him her or them in any Trade business or employment or otherwise for his her or their Advancement or benefit in the World And I give and devise the said Messuage or Tenement Hereditaments and Premises situate standing and being in Haversham aforesaid now in the occupation of the said Sarah Dampier unto the said William Godfrey and William Greaves and their Heirs Upon Trust to pay and apply the Rents issues and profits of the same as received unto my said Wife Susanna Greaves or her assigns or otherwise to permit and suffer her my said Wife to reside in and occupy the same for and during the Term of her Natural life so long as she shall remain my Widow And from and immediately after the decease or Marriage which shall first happen of her My said Wife Then as such Messuage or Tenement hereditaments and premises Upon Trust that they my said Trustees or Trustee do and shall sell the same in such manner as is hereinbefore by me directed in regard to my said other real Estate to whom I do hereby give and extend the like powers for Establishing the validity of their or his receipts or receipt for the purchase Money thereof And of indemnification to the purchaser or purchasers of the same in respect of its application in as full ample and effectual Manner to all intents and purposes whatsoever as is hereinbefore by me declared of and concerning such my said other real Estate And as to the Monies to arise by such last mentioned sale And also as to the said Stocks funds or securities hereinbefore by me directed to be set apart by my said Trustees or Trustee during the life or Widowhood of my said Wife as aforesaid I do hereby Will order and direct them My said Trustees or Trustee to stand possessed of and entrusted of the same respectively Upon such and the same Trusts ends intents and purposes in every respect as are hereinbefore by me expressed and declared concerning the produce to arise by Sale of my said real and personal Estate directed to be sold immediately upon my decease together with the remainder of my said personal Estate Monies and premises aforesaid Upon such of the same Trusts ends intents and purposes respectively as shall then be subsisting or capable of taking effect Provided also and hereby further will order and direct that My said Trustees and the survivor of them and the Heirs Executors and Administrators of such survivor shall and may retain and reimburse themselves and himself out of the said Trust Monies all such loss costs charges damages and expences which they or he shall or may incur sustain expend or be put unto in or about the Execution of the Trusts hereby in them and him reposed And that they my said Trustees their Heirs Executors and Administrators or any of them shall not be answerable or accountable for any More Money than shall come to their hands respectively Nor for any loss which may happen to the same unless such loss shall happen by or through their or his Wilful Neglect or default nor be answerable or accountable the one for the other but each of them for his own acts and deeds only joining in receipts acquittances and other discharges for the sake of Conformity notwithstanding And lastly I do hereby nominate constitute and appoint the said William Godfrey and William Greaves joint Executors of this my Will And hereby revoking and making void all former and other Wills and testamentary Instruments by me at any Time heretofore made I do declare this alone to be and contain my true last Will and Testament In Witness whereof I the said Thomas Greaves the Testator have to this my last Will and Testament contained in five sheets of Paper and to each sheet thereof set my hand and seal this seventh day of August in the year of our Lord one thousand and eight hundred and thirty five Thomas Greaves Signed sealed published and declared by the said Thomas Greaves the Testator as and for his last Will and Testament in the presence of us who at his request in his presence and in the presence of each other have hereunto subscribed our Names as Witnesses (the Words "provided she shall remain My Widow "between the twenty fifth and twenty sixth lines of the second sheet and the Words "or during her Widowhood" between the fourth and fifth lines "or so long as she shall remain My Widow" between the thirty third line and thirty fourth Lines "or Marriage which shall first happen " between the thirty fourth and thirty fifth lines of the third sheet respectively and the Words "or Widowhood" between the tenth and eleventh lines
