Daniel Smith

In the name of God Amen The Thirteenth day of Aprill in the twentieth year of the year of the reign of our most gracious Sovereign Lord Charles by the grace of god of England Scotland France and Ireland King defender of the faith etc. Annoq Dm 1644 I Daniel Smith of little Linford in the County of Bucks yeoman, weak in body but of good and perfect remembrance (praise be to god therefore) doe make and ordaine this my last will and Testament in manner and form following (that is to say) First I bequeath my soule into the handes of almighty god my maker and redeemer and my bodie to be decently buried in the parish Church of great Linford And as touching my landes and Tenementes goods and Chattels I dispose of the same as followeth Imprimis I give and bequeath unto Martha Peter my goddaughter the wife of Richard Peter twenty poundes Item I give unto Master Peter the daughter of Richard Peter three pounds six shillings and eight pence of lawful English money both of them to be payed by myne executor hereafter named both when six months next after my decease Item I give to all my second Cosens  Twenty shillings apeece to be payed also within six months next after my death Item I give to the poore of the Parish of great Linford twenty shillings Item I give to the poore of Haversham  twentie shillings to be payed her likewise within six months next after my decease Item I give to Susan Abbott the wife of John Abbott and to Marth Abbott the daughter of John Abbott and to Martha Smith the daughter of Richard Smith the somme of three pounds six shillings and eight pence apeece her of lawful money of England  to be payed to every of them likewise within six months after my decease Item I give to my sister Smith twenty shillings and to Elizabeth the wife of Richard Smith twenty shillings Item I give to John Abbott one paire of gloves of three shillings fower pence price And alsoe to Richard Peter one paire of gloves of three shillinges and foure pence price And to George Smith one paire of gloves of three shillinges and foure pence price Provided allwaise that if my said legatees shall not like of this my last will and fall out with mine executor because their legacies are noe greater, my will and minde is that then they shall have nothing at all but shalbe absolutely barred and deprived of this my gift as aforesaid Item I give and bequeath unto Roger Smith the sonne of Richard Smith the lease of my ground which I hould at Hanslopp And alsoe my freehould Landes and tenementes which I have withered in the parish of Hanslopp aforesaid to hould to him and his heires forever To enter upon the said lease and freehold when he the said Roger shall accomplish the age of one and twenty yeares and not before For my will and minde is that untill that tyme my executors shall have hould and enioy [enjoy] the same and every parte thereof  Provided alsoe and my minde and will is that the said Rogers Smith shall at any tyme before he shall attaine the said age of one and twenty yeares shewe or carry himself uncivill wild or of rude behaviour and will not be ruled by his parents and my executor and overseer hereafter named Then he shall have only five poundes and noe more and that he shall not have any thing at all to doe either with the said lease or freehould land as aforesaid but the same and every parts thereof shallbe at the free disposeing of my said executor And all the Leggacies being payed and my funeral expences discharged I give and bequeathed unto Richard Smith of great Linford yeoman whom I make my sole executor of this my last will and Testament hereby utterly revokeing all former wills and testamentes whatsoever by me made And I doe hereby appoint overseers of this my last will my loving friendes Thomas Nicholls and John Smith both of great Linford yeomen desireing them to see the same Performed according to my true meaning And I doe give unto them for their paines two shillinges and six pence a peece In witness whereof I have here unto sett my hand and seals the day and yeare first above written The marke of Daniel Smith Published in the presence of The marke of John Smith of great Linford John Chapman for
