These Documents described were given to the North Crawley Historical Society and Shaun Higgins asked for my help in identifying and transcribing them. They are important Manor Court Rolls which in my opinion should be placed on loan in the Buckinghamshire County Record Office where they will be stored in ideal environmental conditions. These documents have no real display value as very few people would be able to read them and handling is detrimental. The fact that they have survived so far is due to their being stored over the years in a Solicitors Office.
Dennis Mynard, December 2017.
INTRODUCTION
The documents are Court Rolls which are the record of the proceedings of Manorial Courts and are useful in that they record the names of parishioners and details of property held.
By the time of Domesday Survey 1086 the Manorial system was established throughout most of the country. Manors were held by a landlord, as a tenant of the Crown, or of a Lord who held the land directly from the Crown.
The Manor an economic unit consisted of the Demesne which was the land the Lord retained for his own use the remainder of the land was tenanted or used as Common Land or Waste.
The main types of tenant were Villeins who occupied their lands on condition of rendering services to the Lord and Freemen who paid a rent to the Lord.
At Manorial Courts the keeping of Law and Order in the Manor was decided. The Title of the various lands held by the tenants was recorded and written on the Manor Court Rolls, of which the Lord held a copy - hence the name Copyhold. The name Rolls relating to the fact that these early documents were generally rolled up for storage.
All conveyances of Copyhold land had to pass through the Court, the Lords financial interests being preserved by the payment of an entry fine on new tenants. In addition a person inheriting land would have to give the Lord the deceased’s best beast or a cash payment before he could hold it.
There were two types of Court the Court Baron and the Court Leet, in practice the functions of these Courts were not always kept distinct.
THE COURT BARON
The Lord of the Manor usually held a Court Baron for his local tenants every three weeks. The business being to state the customs of the Manor relating to land tenure or use, and to ensure payment of all dues and performance of services owed by tenants to the Lord.
The Court Baron enforced a system of local government with jurisdiction over disputes between individuals and personal actions by tenants, such as recovery of small debts and complaints of trespass. At the Court local officers were appointed including the Reeve or Bailiff who collected the Lord's dues and the Hayward who was responsible for the repair of fences and enclosures to stop cattle straying.
THE COURT LEET AND THE VIEW OF FRANKPLEDGE
The Court Leet was usually held by the Lord every six months; the records of this Court were often called the View of Frankpledge. At this Court criminal jurisdiction was granted to a trusted Lord by the Crown. Some local officers, including the Constable, were appointed at this Court.
At the View of Frankpledge tenants of a Manor were held responsible for the actions of others within a grouping of ten households. They were therefore responsible to see that other tenants and inhabitants who were charged with a crime appeared in the Court to answer the charge.
The Manor Court was normally held at a place prescribed by custom, for example the Hall of the Lord's house or even in the Open Air at some local site. Sometimes the Lord of a small manor presided but more often, and especially for larger manors, this function was performed by the Lord's Steward or a deputy.
Free tenants were required to attend Court Baron whilst in other Courts the obligation was only for a few attendances a year. However, the Villeins by reason of their status were obliged to attend and those who failed to attend at three consecutive courts, or did not provide an excuse were fined.
In a large Manor or group of Manors the Steward summoned the Court by message to the local Bailiffs, who fixed a notice to the church door or had it read out in church.
The Court was opened and closed with a Formal proclamation, jurors answered to their names, which are sometimes recorded in the Roll, and swore, usually four at a time, to make a true presentment. The names of absentees and of offenders were recorded, then the Court noted any surrenders, transfers, or other transactions involving land in which the Lord was financially concerned.
New tenants were formally admitted on payment of the customary fees or fines, with due performance of the usual manorial ceremonies, they then swore an oath of fealty (obligation of faithfulness) to the Lord.
Records of the Manor Courts became fuller and more formal by the later medieval period existing as drafts or fair copies. Up to 1733, with the exception of the period of the Commonwealth, they were written in Latin, but the actual Court proceedings were conducted in English. Presumably the scribe made a hasty record in Latin, hence the need for the use of abbreviations and common form phrases.
THE TRANSCRIPTS
I have transcribed the Rolls as far as possible but my knowledge of Latin is limited also the handwriting and the abbreviations used make it more difficult. For those recorded in Latin I have only typed the lists of the people attending.
Apart from a Deed of 1598 the earliest ones had been numbered many years ago with a number in a circle. From an original sequence of 1 -29, which ranged from 1610 to 1703, the following are missing 1-4, 27 and 28. The ones present are all Court Rolls and Views of Frankpledge.
In my transcripts I refer to the deeds by their original numbers. I have numbered the later ones and added a prefix NC for North Crawley. The later deeds from NC28 are mostly in English and I have transcribed several completely. I do not have the time or the eyesight to do the rest but have numbered them, typed and identified their Title and date etc.
These documents are not very photogenic but Shaun has taken a few photographs and intends to continue the transcribing.
