Indenture 1858 between George Henson Capes & Charles A. Gore

This Indenture made the twenty sixth day of April One thousand eight hundred and fifty eight Between George Henson Capes of No 15 Union Street East Spitalfields in the County of Middlesex Surgeon & Bachelor of the first part The Honorable Charles Alexander Gore a Commissioner of Her Majesty's Woods Forests and Land Revenues to whom have been assigned the management and Direction of certain parts of the Land Revenues of the Crown with certain duties and powers relating thereto including a power to purchase the hereditaments after described on behalf of Her Majesty of the second part and The Queens Most Excellent Majesty of the third part Whereas the said Charles Alexander Gore as such commissioner as aforesaid under the authority of an Act of Parliament passed in the tenth year of the reign of His late Majesty King George the fourth Chapter 50 and of another Act passed in the fifteenth year of the reign of Her present majesty Chapter 42 and with the consent of the Commissioners of Her Majesty's Treasury testified by their Warrant has contracted with the said George Henson Capes for the absolute purchase of the land and hereditaments hereinafter described and of the inheritance thereof in fee simple free from all incumbrances for the price of One Hundred and thirty pounds and the said George Henson Capes has agreed to enter into the absolute Covenants hereinafter contained Now This Indenture witnesseth that in consideration of the price of One Hundred and thirty pounds paid by the said Charles Alexander Gore as such commissioner as aforesaid to the said George Henson Capes upon the execution of these presents the receipt whereof he the said George Henson Capes cloth hereby acknowledge and from the same doth acquit release and discharge the said Charles Alexander Gore and also the Queens Majesty her heirs and successors He the said George Henson Capes Doth grant release and convey unto the Queens Majesty Her Heirs and Successors All that piece or parcel of Pasture Land situate lying and being in the Parish of Passenham in the County of Northampton containing one acre and thirty six perches or thereabouts bounded on the South west by Eustalus Coppice and other parts of Shrob Walk in the late Forest of Whittlewood on the North East and part of the South East by the West Chester Turnpike Road and on other part of the South East by land belonging to Lord Maynard which said piece of land intended to be hereby conveyed was formerly in the occupation of Robert Truss and is delineated in the plan drawn in the margin of these presents being thereon colored red Together with all the trees hedges ditches fences ways waters watercourses common liberties easements and appurtenances whatsoever to the said piece of land and hereditaments appertaining or belonging And all the estate right title and interest of the said George Henson Capes therein And the reversion and reversions remainder and remainders rents issues and profits thereof To have and to hold the said land and hereditaments and other the premises hereinbefore expressed to be granted released and conveyed Unto and to the Use of The Queens Majesty her heirs and successors for ever as part of the Land Revenues of the Crown And the said George Henson Capes doth hereby for himself his heirs executors and administrators covenant with The Queens Majesty her heirs and successors that he the said George Henson Capes now hath good right and full power to grant release and convey the said land and hereditaments hereinbefore expressed to be granted to be released and conveyed in manner aforesaid and according to the true intent and meaning of these presents And ALSO that that it shall be lawful for Her Majesty her heirs and successors at all times hereafter peaceably and quietly to enter into and upon and take the rents and profits of the said land and hereditaments without any interruption or disturbance of the said George Henson Capes or any other person or persons whomsoever And that freed and discharged from or other wise by the said George Henson Capes his heirs executors or administrators sufficiently indemnified against all estates incumbrances claims and demands whatsoever created occasioned or made by any person or persons whomsoever And Further that the said George Henson Capes and his heirs and every person lawfully or equitably clamming any estate or interest in the said premises will at all times at the costs of Her Majesty her heirs or successors execute and do every such lawful assurance and thing for the further or more perfectly assuring the said land and hereditaments to the use of the Queens Majesty her heirs and successors as by the said Charles Alexander Gore or other the Commissioner or Commissioners for the time being of Her Majesty’s Woods Forests and Lands Revenues or the Law Officers of the Crown shall be reasonably required And the said Charles Alexander Gore both hereby direct that this Deed shall be deemed to be sufficiently inrolled  by the deposit of a Duplicate thereof in the Office of Laws Revenue Records and Inrolments and the filing or making an entry of such deposit by the Keeper of the said Records and Inrolments  In Witness whereof the said parties hereunto of the first and second parts have hereunto set their hands and seal the day and year first above written
