Kezia Brittain 1830

This is the last Will and Testament of me Kezia Brittain of Old Stratford in the County of Northampton Widow wherein I mean to make a full and complete disposition of all my Estate and Effects and not to die intestate as to any part thereof First I give and bequeath unto my Daughter Sarah the Wife of [Henry Frederick] Tiark the sum of one hundred and twenty pounds to be paid to her by my executors hereinafter named out of my personal estate And as to all the rest residue and remainder of my Estate and Effects whatsoever and wheresoever and of what nature or kind soever whether in possession reversion or remainder or expectancy I give devise and bequeath unto Robert Marriott Freeman of Stony Stratford in the County of Bucks Surgeon his Executors Administrators and Assigns upon Trust to make sale of and convert into money all such part and parts thereof and shall not consist of money and call in and compel payment of all such parts thereof of as shall consist of money out upon Security or Interest or otherwise and also collect all debts owing to me at the time of my death in such manner as he or they shall think expedient and for this purpose it shall be lawful and I do hereby authorize and empower him my said Trustee his executors administrators and assigns to compromise and compound debt sum or sums of money which may be a owing to me at the time of my decease and to give or allow such reasonable time by way of indulgence for the payment of the same or any part thereof and in the meantime to take and accept such security or assurance for the payment as he or they in his or their discretion shall think fit and the receipt or receipts of him or them for all monies paid or securities given under or by virtue of this my Will shall in all cases be a sufficient and effectual discharge or discharges for such sum and sums of money or securities for money as shall therein respectively be expressed or are acknowledged to have been received or given and the person or persons paying any debt or debts sum or sums of money his her or their heirs executors or administrators shall not afterwards be obliged to see the application thereof or be in any manor answerable or accountable for the loss misapplication or nonapplication of the same or any part thereof and it is my will an desire that the said Robert Marriott Freeman his executors administrators and assigns shall stand and be possessed of and hold the monies to arise and be gotten in the means aforesaid or otherwise under or by virtue of this my Will in trust in the first place to satisfy and discharge all such debts as shall be due and owing by me to any person or persons whomsoever at the time of my decease and in the next place to pay satisfied and discharge my Funeral and Testamentary expences and the said Legacy and bequest of one hundred and twenty and pounds to my said daughter Sarah and which said sum of one hundred and twenty pounds I do hereby direct shall be paid to my said daughter within twelve months next after my decease and to declare that the receipt and receipts of my said daughter Sarah shall notwithstanding her coverture be good and effectual discharge and discharges for the same and after full payment and satisfaction thereof then in trust to pay all the rest and residue of the product and proceeds of my estate and effects unto and equally between my daughter Elizabeth the Wife of George Stevenson and my said daughter Sarah the Wife of [left blank] Tiark share and share alike two and for their own separate use and benefit and I do hereby declare that the receipt and receipts of my said daughters respectively shall notwithstanding their coverture be good and effectual discharge for the payment thereof Provided always and it is my will and I do hereby direct that it shall and may be lawful two and for my said Trustee his executors administrators by and out of the said trust money herein before mentioned to deduct and reimburse to himself and themselves from time to time all such costs charges damages and expences as he or they or any of them shall be put unto pay suffer or sustain for or by reason of any of the trusts hereby in him or them are reposed or in the management or execution thereof or for or by reason of any other matter or thing in anywise relating thereto And lastly I do hereby nominate constitute and appoint the said Robert Marriott Freeman sole Executor of this my last Will and Testament hereby revoking all Will and Wills by me at any time heretofore made I do declare this and this only to be my last Will and Testament In Witness whereof I the said Keziah Brittain to this my last Will and Testament contained in four sheets of paper affixed together have to the first three sheets thereof set my hand or mark and to this fourth and last sheet thereof my hand or mark and seal this twelfth day of September one thousand eight hundred and thirty The Mark of Kezia Brittain as and for her last Will and Testament in the presence of us who in her presence at her request and in the presence of each other have here unto subscribed our names as witnesses here two the same having been first read over to her the said Keziah Brittain the Testator in our presence and she seemed perfectly to understand the same
