Arthur Capes 1835

I Arthur Capes of Old Stratford in the County of Northampton having made a Will bearing date 26 January 1830 where he and I have made certain sums of money borrowed by my Son Joseph Capes amounting to £900 referred to in my said Will payable with Interest during the lifetime of my wife Mary do now or Will and desire my Executors and Trustees of my said Wife therein named and appointed to release my Son Joseph Capes from the payment of interest on the aforesaid sum of £900 after my decease whereupon I do revoke and annul that part of the said Will as relates to the interest of my son Joseph’s debt In Witness whereof I do affix my hand and seal this twenty first day of January one thousand eight hundred and thirty five  Ar Capes Signed and sealed and published and declared by the said Arthur Capes the Testator as and for a Codicil to the last Will and Testament in the presence of us in his presence and at his request in the presence of each other here unto subscribed our names as witnesses Martha Timbs of Old Stratford John Norton of Old Stratford County of Northampton

This further Codicil to the Will as contained in Paper Writings marked A and B (with a Codicil already Proved a Arthur Capes was proved at London 12th January 1836 before the Worshipful Jesse Addams  Doctor of Laws and Surrogate by the Oath of Joseph Capes the Son and one of the Executors named in the said Will to whom Administration was granted having been first sworn duly to administer Power received of making the like Grant to Mary Capes Widow the Relict of Arthur Capes the Son William Gallard and Francis Smith the other Executors named in the said Will when they shall apply for the same.
