Edward Proctor 1808

This is the last Will and Testament of me Edward Proctor of Old Stratford in the County of Northampton Gent being of sound Memory and understanding First I direct all my Just Debts Funeral and Testamentary Expences to be paid by my Executors here after named And I give and devise unto my two sons William and Joseph and my daughter Ann all that my Messuage Tenement or Inn and Close with the appurtenances in Stony Stratford And my two Closes of Pasture Land in Woolverton now let to Mr. John Malpas on Lease for the term of ten years from Michaelmas last also all that my Barn and Premises in Stony Stratford aforesaid in the occupation of Mr. William Godfrey also all those my three Messuages Cottages or Tenements and Premises with their appurtenances in Potterspury in the said County of Northampton And also all other my Messuages and Closes Lands Tenements hereditaments and real Estate whatsoever to hold the same and every part thereof unto my two Sons William and Joseph and my said Daughter Ann their heirs and Assigns for ever to take as Tenants in Common and not as Joint Tenants but it is my will and I had do hereby direct that my said two Sons and Daughter shall not sell or mortgage or any part of my said real Estate till after the expiration of these case granted to the said John Malpas as aforesaid nor shall let the said Sum and Premises or any part thereof to the said John Malpas or any of his Family after the expiration of the present Lease and I direct that if either or any of my said Sons or Daughter shall happen to die before the expiration of the said lease their shares or share of him her or them so dying shall go to the Survivors or Survivor his her or their heirs and assigns And if my said Sons and Daughter shall not conform to the directions of this my will in that Case I give and devise all my said real Estate to my two Nephews Thomas Proctor of North Hall and Joseph Proctor of Stony Stratford their heirs and Assigns and all my Monies Securities for money Goods Chattels and Effects and all other my personal Estate whatsoever subject to the payment of my Debts Funeral and Testamentary Expences as aforesaid and Legacies to my Executors hereinafter named I give and bequeath unto my said two sons William and Joseph and my daughter Ann to be equally divided amongst them shares and share alike And lastly I do hereby nominate constitute and appoint my two Friends John Gray of Leighton in the County of Bedford and Robert Battams of Woolverton aforesaid Gentleman Executors of this my last Will and I give to my said Executors or some of ten pounds each for the Trouble they may have in the execution of this my Will and I do hereby revoke all other Wills and Testamentary Just…  heretofore by me made  In Witness whereof I the said Edward Proctor the Testator have to this my last Will and Testament contained in two sheets of Paper and to each sheet thereof set my hand and Seal the first day of January in the year of our Lord one thousand eight hundred and three Edwd Proctor Signed sealed published and declared by the said testator Edward Proctor as and for his last Will and Testament in the presence of us who in his presence at his request and in the presence of each other have subscribed our Names as Witnesses Thos Worley Edwd Hutchings Saml Green
