Richard Sirett 1813

This is the Last Will and Testament of me Richard Sirett of Old Stratford in the County of Northampton Gentleman being of sound memory and understanding First I Will order and direct that my just debts Funeral and Testamentary Expences shall be paid And I give and devise all and every my Messuages Cottages Tenements Closes Lands Hereditament and Real Estate whatsoever unto my Wife Jane Sirett and her Assigns for and during the term of her natural life and from and after her decease I give and devise all that my now erected Messuage or Tenement and Premises with the Appurtenances situate and being on the East side of Stony Stratford in the County of Buckingham in the occupation of my Son in Law John Covington unto my two Friends George Wallis of Stony Stratford aforesaid Draper and Anthony Chibnall the younger of Pouxley in the County of Northampton Gentleman and the Survivor of them and the heirs of such Survivor Upon Trust to permit and suffer my daughter Elizabeth the Wife of the said John Covington to hold and occupy the Messuage or Tenement and premises or if she shall desire it to let the same and to pay the Rents and profits thereof as and when they shall receive the same unto my said daughter Elizabeth Covington and two and for her own Sole and separate use and benefit for and during the term of her natural life the same or not to be subject and to the debts control or engagements of her present or any future Husband And I direct that her Receipt alone notwithstanding her Coverture given to my said Trustees or either of them for the same or any part thereof shall be a good and sufficient discharge and after the decease of my said daughter Elizabeth Covington I give and devise my said Messuage or Tenement and premises unto my said Son in Law John Covington and his Assigns for and during the term of his natural life and after the decease of the said John Covington and Elizabeth his Wife I give and devise the said Messuage Tenement and premises unto all the Children of the said John and Elizabeth Covington then living there Heirs and Assigns to take as Tenants in common And if but one Child then to such only Child his or her Heirs and Assigns for ever And in default of Issue living then I give and devise one Moiety or equal half part thereof unto all the Children of my daughter Kitty the Wife of Joseph Hamblin their Heirs and Assigns to take as Tenants in common and if but one Child then to such only Child his or her or her Heirs and Assigns for ever and the other or remaining Moiety or half part thereof I give and devise unto all the Children of my three sons William Sirett Richard Sirett and John Sirett their Heirs and Assigns for ever to take as Tenants in common and if my said daughter Kitty Hamblin shall not have any Child then living I give and devise the whole of my said Messuage or Tenement and premises to the Children of my said sons William Richard and John their Heirs and Assigns to take as Tenants in Common But in case my said daughter Elizabeth Covington shall be minded and desirous that the said Messuage or Tenement and Premises  should be sold and converted into Money in her lifetime then and in such case I do hereby fully impower the said George Wallis and Anthony Chibnall the younger and the Survivor of them and the Heirs of such Survivor on such of my said daughters request in Writing to make sale of the said Messuage or Tenement and premises to such person or persons who shall be willing to purchase the same either by private or public Sale and for such price as they shall deem the fair value thereof and to convey and assign the same unto the purchase thereof and I direct that on such Sale the Receipt and Receipts of my said Trustees and the Survivor of them and the heirs of such survivor shall be a good and sufficient discharge to the purchaser or purchasers of the said Messuage or Tenement and premises and I further direct that the Monies to arise from such Sale as aforesaid shall be placed out at Interest by my said Trustees for the use and benefit of my said daughter Elizabeth Covington and to be by them paid and disposed of in the same manner as my said daughter share of the Trust Monies here in after by me given and bequeathed to her are directed to be paid applied and disposed of and not in anywise subject to the debts control or Engagements of her present or any future Husband and I give and devise all that my Messuage or Tenement shop and premises with the appurtenances situate and being in the Market Place in Stony Stratford aforesaid in the occupation of my said son John Sirett also all that my small close of pasture Land on West side of Stony Stratford aforesaid in the occupation of my said son John Sirett and also all other my Messuages Cottages Closes Lands Tenements Hereditaments and Real Estate (not before disposed of) unto the said George Wallis and Anthony Chibnall the younger and the Survivor of them and the Heirs of such Survivor upon trust Nevertheless that they my said Trustees and the Survivor of them and the Heirs of such Survivor shall and do as soon as conveniently may be after the decease of my said Wife make Sale of all and every of my said Messuages Cottages Closes Lands Tenements Hereditaments and Real Estate so devised to them upon Trust as aforesaid either by private Contract or Public Auction and either together or in parcels as to him or them shall seem most expedient for such price or prices as they shall deem the fair value thereof (first offering the said Messuage or Tenement Shop small Close of pasture land and premises to my said Son Johns Sirett at Five hundred and twenty five pounds the price I paid for the same if he chooses to purchase them at that sum) and shall and do convey and assure the same unto the purchaser or respective purchasers thereof and my mind and Will is that upon each and every such Sale the Receipt and Receipts of my said Trustees and the Survivor of them and the Heirs of such Survivor in writing under his or their hands or hand shall from time to time be a good and sufficient discharge to the purchaser and purchasers of my said Estate are directed to be sold and of each and every of them for so much Money as in such Receipt or Receipts shall be expressed to be received and that after such receipt or receipts given such Purchaser or Purchasers respectively or his or their Heirs Executors Administrators and Assigns shall not be answerable or accountable for the same or any part there of or for any loss misapplication or nonapplication thereof or be implicated in the Trusts of this my Will and I direct that my said Son Johns Sirett may continue to hold and occupy the said Messuage or Tenement Shop small Close of Pasture land and Premises now in his occupation for and during the life of my said Wife upon his paying her the clear yearly Rent or sum of twenty pounds for the same and keeping the said house shop and premises in good Repair and I give and bequeath all and singular my household Goods Linen Plate China Glass and Furniture unto my said Wife Jane Sirett to her and for her own use and benefit And I direct that all my horses Wagons Carts Hovels Frames Plough Harrow Farming Utensils and implements in Husbandry shall be valued and appraised to my said Son Richard and that the sum at which the same shall be valued shall be taken and considered as part of his share of my personal Estate hereafter given and bequeathed unto and amongst all my Children and I give and bequeath unto my said Daughter Elizabeth Covington the sum of one hundred pounds to be paid to her by my Executors hereafter named out of my personal Estate within Six Months after my decease Also I give and bequeath unto my said Daughter Kitty Hamblin the sum of Two hundred pounds to be paid to her by my said Executors out of my personal Estate within Six Months after my decease and I give and bequeath all my Stock Crop Corn Grain Hay and Cattle (not before directed to be appraised to my said Son Richard) Monies Securities for Money Book debts Chattels Effects and all other my personal Estate whatsoever (not before disposed of) unto the said George Wallis an Anthony Chibnall the younger and the Survivor of them his Executors Administrators and Assigns Upon trust that they my said Trustees and the Survivor of them his Executors and Administrators shall and do as soon as conveniently may be after my decease sell and convert into Money all such part or parts thereof as shall not consist of Money or securities for Money and shall and do call receive and get in all such part and parts thereof as shall consist of Monies or Securities for Money arising from such sale and Sales and to be so called received and got in as aforesaid in manner hereafter directed and as to the Monies to arise and produced from the Sale of or to be called received or got in as part of my personal Estate as aforesaid my mind and Will is that my said Trustees and the Survivor of them his Executors and Administrators shall and do in the first place thereout pay and satisfy all my just debts Funeral and Testamentary Expences and the said two Legacies to my Daughters Elizabeth Covington and Kitty Hamblin as aforesaid and in the next place I request the said George Wallis an Anthony Chibnall the younger to retain to themselves for their respective use and benefit the sum of Ten pounds a piece which I give and bequeath to them for the trouble they may have in the Execution of the trusts hereby in them reposed And as to the residue or remainder of the said Monies to arise from the Sale of and to call received and got in as part of my personal Estate as aforesaid after payment of my debts Funeral and Testamentary Expenses and the before mentioned Legacies I give and bequeath the same and every part there of unto the said George Wallis and Anthony Chibnall the younger and the Survivor of them his Executors and Administrators Upon trust to place out the same from time to time in or upon such public or private Security or Securities as my said Trustees or the Survivor of them his Executors and Administrators shall think proper and do and shall pay and apply the Interest dividends or a they yearly proceed thereof of as and when the same shall from time to time be received unto the proper hands of my said Wife Jane Sirett during the term of her natural life and from and after her decease I give and bequeath the sum of twenty pounds a piece to all the Children of my said son William Sirett as shall be living at the death of my said Wife to be paid to them at their respective Ages of twenty one years by my said Trustees out of the said Monies soe directed to be placed out at Interest as aforesaid And I give and bequeath the remainder of the said principal Monies and also the Monies to arise from the sale of my said Real Estate unto my five Children the said William Sirett Richard Sirett Johns Sirett Elizabeth the Wife of the said John Covington and Kitty the Wife of the said Joseph Hamblin to be divided amongst them my said Children in a manner and proportions following that is to say First I direct that my said son William Sirett shall take and receive such sum of Money as added to what I have already given to him (an account of which I intend to leave in Writing signed by me for the use of my said Trustees) will make up the same sum of Money which in search account shall be mentioned to have been by me given to my said son John Sirett secondly I direct that my said Son Richard Sirett shall take and receive such sum of Money as are added to what I have already given to him and the amount of the Effects herein before by me directed to be appraised to him will make up the same sum of Money which I have already given to my said Son John Sirett Thirdly I direct that my said Trustees shall retain in their hands for the use of my said Daughter Elizabeth Covington such sum of Money as added to what I have already given to her the Legacy of One hundred pounds herein before by me bequeathed to her and the sum of one hundred and Sixty pounds (the value of I fix on the new erected Messuage or Tenement and premises by me devised for her benefit to as aforesaid) will make up the same sum of Money which I have already given to my said John Sirett and forcefully I direct that my said Trustees shall retain in their hands for the use of my said Daughter Kitty Hamblin such sum of Money as are added two what I have already given to her and the Legacy of Two hundred pounds hereinbefore by me bequeathed to her will make up the said sum of Money which I have already given to my said Son John Sirett and after such several sums have been received by my said Sons William and Richard and retained by my said Trustees for the use of my said Daughters Elizabeth and Kitty to make their respective shares equal to what I have already given to my said son John Then I direct my said Trustees and the Survivor of them his Executors and Administrators to divide all the then residue and remainder of the said Trust Monies into five equal parts or shares and to pay and dispose of the same in the manner herein after by me given and directed that is to say I give and bequeath one fifth part thereof to my said Son William Sirett for his use and benefit and I give and bequeath one hundred pounds part of one other fifth part of the Residue of the said Trust Monies unto my said son Richard Sirett for his use and benefit and I give and bequeath the remainder of the said fifth part unto all the Children of my said son Richard their share or share or shares of such of them as shall be under Age to be applied by my said Trustees to their use and benefit in putting them out at Apprentice or otherwise I give and bequeath one other fifth part thereof unto my said son John Sirett for his use and benefit I give and bequeath one hundred pounds part of one other fifth part of the Residue of the Trust Monies unto my said daughter Elizabeth Covington for her use and benefit and I direct my said Trustees and the Survivor of them his Executors and Administrators to put and place out at Interest the remainder of the said Fifth share and also such sum of Money before directed to be retained by them for her use upon such Security as they shall think proper two and for the use and benefit of my said daughter Elizabeth Covington the same not to be subject to the debts control or Engagements of her present or any future husband And I direct my said Trustees and the Survivor of them his Executors and Administrators as and when the same shall be received to pay the Interest and also to call in and pay such part of the principal Money as she shall have occasion for unto my said daughter Elizabeth Covington and I direct that her Receipt alone notwithstanding her Coverture shall be a good and sufficient discharge to my said Trustees and the Survivor of them his Executors and Administrators for such sum and sums of Money as shall be by them paid to my said Daughter Elizth Covington and I further direct that my said Trustees and the Survivor of them his Executors and Administrators shall and do after the decease of my said daughter Elizabeth Covington pay and apply all and every such some and sums of Money then remaining of her share of the said Trust Monies (if any) unto and amongst all the Children of my said daughter Elizabeth Covington share and share alike and at one Child then to such only Child And in default of Issue living then to pay one Moiety or equal half part there of unto the Children of my said daughter Kitty Hamblin and the other Moiety to the Children of my said sons William Richard and John and if my said daughter Kitty Hamblin shall not have any Child or Children then living I direct the whole of such Monies to be paid to the said Children of my said sons William Richard and John share and share alike And I give and bequeath Two hundred pounds part of the other or remaining fifth part of the Residue of the said Trust Monies unto my said daughter Kitty Hamblin for her own use and benefit And I direct my said Trustees and the Survivor of them his Executors and Administrators to put and place out at Interest the remainder of the said fifth share and also such sum of Money before directed to be retained by them for the use and benefit of my said daughter Kitty Hamblin the same not to be subject to the debts control or Engagements of her present or any further Husband And I direct my said Trustees and the Survivor of them his Executors and Administrators as and when the same shall be received to pay the Interest And also to call in and pay such part of the principal Money as she shall have occasion for unto my said daughter Kitty Hamblin and I direct that her Receipt alone notwithstanding her Coverture shall be a good and sufficient discharge to my said Trustees and the Survivor of them his Executors and Administrators for such sum and sums of Money shall be by them paid to my said daughter Kitty Hamblin And I further direct my said Trustees and the Survivor of them his Executors and Administrators shall and do after the decease of my said daughter Kitty Hamblin pay the Interest of all such sum and sums of Money (if any) unto her Husband the said Joseph Hamblin for and during the term of his natural life and after his decease I direct my said Trustees to call in and pay the said principal Monies unto and amongst all the Children of my said daughter Kitty Hamblin share and share alike and if but Child then to such only Child and into a fault of Issue living then to pay one Moiety or equal half part thereof unto the Children of my said daughter Elizabeth Covington and the other Moiety to the Children of my said Sons William Richard and John and if my said daughter Elizabeth Covington shall not have any Child then living I direct the whole of such Monies to be paid to the Children of my said Sons William Richard and John share and share alike And my Will further is and I do hereby declare that my said Trustees and the Survivor of them his Executors and the Survivor of them his Heirs Executors and Administrators shall not be charged or chargeable with or accountable for any more of the aforesaid Trust Estate Monies and premises they respectively shall actually receive or shall come to their respective hands by virtue of this my Will nor with or for any loss which shall happen to the same or any part thereof so as such loss happen without their wilful neglect nor shall be answerable or accountable the one for the other but each of them for his own Acts and Deeds only and also that it shall and may be lawful for my said Trustees and the Survivor of them his Heirs Executors and Administrators  in the first place by and out of the aforesaid Trust Monies Estates and premises to deduct and reimburse himself and themselves all such loss Costs charges and Expences as he or they shall respectively sustain expend or be put unto for or by reason or means of the several Trusts hereby in them reposed or in the management and Execution thereof or any other thing in anywise relating thereto And lastly I do hereby nominate constitute and appoint my said Wife Jane Sirett and the said George Wallis and Anthony Chibnall the younger Executrix and Executors of this my Will and I do hereby revoke all other Wills and Testaments Instruments heretofore by me made In Witness whereof I the said Richard Sirett the Testator have to this my last Will and Testament contained in Eight Sheets of paper and to each Sheet thereof set my hand and Seal the twenty fifth day of November in the year of our Lord one Thousand Eight hundred
