Will of Barbara Gallard 1842

This is the last Will and Testament of me Barbara Gallard of Yardley Gobion in the County of Northampton Spinster ffirst (sic) I direct that all my just debts funeral and testamentary expenses shall be fully paid and satisfied by my Executor hereinafter named I give and bequeath to my Niece Ann Taylor of Abingdon in the County of Berks Spinster my best half dozen of Tea spoons Strainer Spoon and Sugar Tongs I give and bequeath to my Niece Harriett Taylor of Daventry in the County of Northampton Spinster my bed bedstead and hangings one bolster three pillows and one blanket half a dozen tea spoons one gilt tea spoon and my Oak Drawers I give my Nephew William Gallard of Yardley Gobion aforesaid ffarmer (sic) my Mahogany Beareau (sic) and to Sarah his wife one pair of Gravy Spoons To my Niece Mary Gallard daughter of Thomas and Mary Gallard one small Table spoon not marked and to my Niece Sarah Gallard another of the daughters of the said Thomas and Mary Gallard my small desk I desire that all my linen may be equally divided between my two Nieces Maria Capes and Kitty Smith my Nieces the said Ann Taylor Harriett Taylor and Sarah Gallard my Niece Mary Ann Clare Ann ffranklin (sic) the wife of John ffranklin of Towcester and Samuel Gallard of Loughton and my wearing apparel divided amongst my Nieces the said Ann Taylor Harriett Taylor Sarah Gallard wife of the said William Gallard Maria Capes Kitty Smith and the said Mary Ann Clare I give and bequeath unto my said Nephew William Gallard all my household goods and furniture except as heretofore disposed of and also all my monies and securities for money money in the funds and all other my Personal Estate and effects whatsoever and wheresoever and of what nature and sort soever the same may be upon trust that he do and shall immediately after my decease call in and convert the same as does not already consist of money into money and stand possessed of and interested therein and pay thereout unto my three Nieces the said Ann Taylor Harriet Taylor and Mary Ann Clare the sum of one hundred pounds each to whom I give and bequeath the same accordingly to and for their own absolute use and benefit and as to the residue and remainder of my monies securities for money and money in the funds and all other my personal Estate and Effects after payment of the said several legacies I direct the said William Gallard to pay and divide the same in such proportion as follows that is to say one equal sixth part thereof to my brother Joseph Gallard to whom I give and bequeath the same accordingly one other equal sixth part thereof to my brother Thomas Gallard to whom I give and bequeath the same accordingly one other equal sixth part thereof to my sister Mary Capes wife of Arthur Capes of Old Stratford in the said County of Northampton Gentleman to whom I give and bequeath the same accordingly one other equal sixth part thereof to my two Nephews Samuel Clare and Joseph Clare and my Niece the said Mary Ann Clare to whom I give and bequeath the same accordingly one other equal sixth part thereof to my Nieces the said Ann Taylor Harriett Taylor and Sarah Gallard the wife of the said William Gallard to whom I give and bequeath the same accordingly and the other and remaining equal sixth part to my Nephew Thomas Watts Samuel Tarry to whom I give and bequeath the same accordingly which said several legacies and residuary shares I do will and direct my Executor to pay within six months next after my decease Provided always nevertheless and it is my express will and intent and I do hereby declare that in the event of the death of either of my said brothers or sisters happening in my lifetime the child or children of such deceased parent shall be entitled to the same sixth part or share of the said residue as such parent would have been entitled to if living and my will and mind is and I do hereby direct that the said William Gallard his heirs executors administrators or assigns shall be charged and chargeable only with such monies as shall actually come into his hands nor be accountable for any banker broker or other person with whom or whose hands any of the said trust monies may be placed for safe custody or otherwise in the execution of any of the said trusts contained in this my Will and also that he the said William Gallard his heirs executors and administrators shall and may be out of the monies that shall come into his hands by virtue of the trusts of this my Will retain to and reimburse himself and themselves all such costs charges and expenses as he shall sustain expend disburse or be put unto? in or about the execution of the trusts hereby in him reposed or in or otherwise relating thereto and lastly I do hereby nominate constitute and appoint the said William Gallard Executor of this my last Will and Testament hereby revoking all former Wills by me at any time heretofore I declare this to be my last Will and Testament In witness whereof the said Barbara Gallard the Testatrix have to this my last Will and Testament set my hand and seal this tenth day of August in the year of our Lord one thousand eight hundred and thirty two - Barbara Gallard (LS) - Signed sealed published and declared by the said Barbara Gallard the Testatrix as and for her last Will and Testament in the presence of us who in her presence at her request and in the presence of each other have hereunto subscribed our hands as witnesses Edmd Reeve Clerk to Mr E A Worley Solr Stony Stratford Elizabeth Windleburrow Servant to Mr Capes

A Codical (sic) to the Will of Barbara Gallard Spinster I give and bequeath to Mary Gallard daughter of Thomas and Mary Gallard the sum of one hundred pounds and likewise to Sarah Gallard daughter of the above Parents the sum of one hundred pounds of lawfull (sic) money of Great Britain and it is my further wish that the said Mary and Sarah Gallard shall further have part of the share of the residue of my Personal property with their brothers As witness my hand this eighth day of September 1838 - Barbara Gallard - Witness to the above Wm Gallard - Sarah Gallard

Appeared Personally William Gallard of Yardley Gobion in the Parish of Potterspury in the County of Northampton ffarmer and referring to the Codicil to the last Will and Testament of the said Barbara Gallard late of Yardley Gobion in the County of Northampton Spinster deceased the said Codicil being now hereunto annexed bearing date the eighth day of September 1838 made Oath that on the said day the said Testatrix duly executed such Codicil by signing her name at the end thereof in the joint presence of Sarah Gallard of Yardley Gobion aforesaid the wife of this deponent and the deponent both of whom thereupon attested and subscribed the said Codicil as witnesses of the due execution thereof in the presence of the said Testatrix William Gallard On the 21st day of October 1842 the said William Gallard was duly sworn to the truth of this Affidavit by virtue of Commission annexed Before me - William Haughton Commr

Proved at London with a Codicil 24th October 1842 before the Judge by the Oath of William Gallard the Nephew the sole Executor to whom Admon was granted having been first sworn by commission duly to administer.
