In the Name of God Amen this is the last Will and Testament of me John Boswell of Yardley Gobion in the County of Northants Yeoman as followeth (that is to say) First I give and devise all that my Messuage or Tenement with the out Buildings and appurtenances thereunto belonging scituate standing and being in Yardley Gobion aforesaid wherein I now Inhabit and Dwell And also all that little Tenement with the appurtenances in Yardley Gobion aforesaid now in the tenure or occupation of Thomas Bishop unto my Daughter Elizabeth Boswell for and during the term of her natural life if she shall so long continue single and unmarried and from and after her decease or Intermarriage which shall first happen I give and devise the same unto my Grandson Thomas Boswell and his heirs for ever Also I give unto my said daughter Elizabeth Boswell the sum of three hundred pounds to be paid to her by my Executors hereinafter named within Six Months next after my decease Also I give and devise All and Singular My Lands Tenements and Hereditaments scituate standing Lying and being in Yardley Gobion aforesaid and Sulgrave in the said County of Northampton unto my two friends John Smith of Potterspury Lodge in the County of Northampton aforesaid and Richard Scrivener of Potterspury aforesaid their Executors Administrators and Assigns for the term of five hundred Years Neveretheless to and upon the Trusts and for the intents and purposes hereinafter Expressed and Declared of and concerning the same and from and after the expiration or other sooner determination of the said Term of five hundred Years I give devise and bequeath the same unto my said Grandson Thomas Boswell and to his heirs and assigns for ever Chargeable Nevertheless and to stand Charged with the payment of the sum of two hundred pounds unto my Grandson John Boswell when he shall attain to the age of Twenty one Years And I do hereby direct appoint and declare my Will and meaning to be that the said Term and estate of five hundred Years hereinbefore given and limitted in the said premises is so given and Limitted Upon Trust and to the intent and purpose that the said John Smith and Richard Scrivener or the Survivor of them his Executors Administrators or Assigns shall and will by Mortgage or Mortgages Sale or Sales thereof or of any part thereof Levy and Raise the sum of three Hundred pounds and pay the same in manner following (that is to say) the sum of two hundred pounds part thereof unto the four Children of my son in law Benjamin Sheen to be equally divided between them share and share alike within Six Months next after my decease and I do hereby direct that their Fathers Receipt shall be a sufficient discharge for the same and if any or Either of them shall happen to die before his her or their Legacy or Legacies shall become due and payable that the Legacy or Legacies of him her or them so dieing shall be equally divided between the survivors of them share and share alike And the further sum of one hundred pounds being the residue and remainder of the said sum of three Hundred pounds unto my Grandaughter and Grandson Mary Newman and John Newman to be equally divided between them within Six Months next after my decease And I do hereby direct that their Fathers receipt shall be a sufficient discharge for the same And if either of them shall happen to die before that the share of her or him so dieing shall be paid to the Survivor of them And my Will and meaning is and I do hereby further direct that the Interest of the said sum of three hundred pounds shall be paid out of part of the Rents Issues and profitts of the aforesaid Premisses and that the residue and remainder thereof shall be paid and applied by the said John Smith and Richard Scrivener for and towards the Maintenance and Education of my said Grandsons Thomas Boswell and John Boswell untill the said Thomas Boswell shall attain to the age of Twenty one Years Also I give unto the said John Smith and Richard Scrivener my Executors and Trustees hereinafter Named two Guineas a piece for their trouble and care in seeing this my Will performed And I do hereby direct and Appoint that the said John Smith and Richard Scrivener shall in the first place be repaid and reimbursed out of the Rents Issues and profits of my Real and personal Estates all charges Damages Expences and Disbursements Whatsoever which they or either of them shall expend sustain or be any ways put unto in the Execution of this my Will or the Trust hereby in them reposed and shall not be answerable for or charged or chargeable with the Acts or Receipts of the other of them but each of them with his and their own several and respective Acts and Receipts only All the Rest residue and remainder of my Goods Chattles and personal Estate whatsoever and wheresoever and of what nature or kind so ever (my Debts Legacies and Funeral Expences being first there out paid and discharged) I give and bequeath the same unto my said Daughter Elizabeth Boswell the four Children of my son in Law Benjamin Sheen and my Grandaughter and Grandson Mary Newman and John Newman to be equally divided between them within six months next after my decease and if either of them shall happen to die before that the share of her or him so dieing shall be paid to the Survivor of them And I Do herby constitute and appoint the said John Smith and Richard Scrivener joint Executors and Trustees of this my last Will and Testament hereby revoking all former Wills by me heretofore made In Witness whereof I have to this my last Will and Testament set my hand and seal this twenty ninth day of Octo[ber] in the Year of our Lord one thousand seven hundred and seventy seven
