In the name of God Amen I Thomas Scrivener of Yardly gobion in the parish of Potersberie in the County of Northampton yeoman being of perfect memory thanks be given to God; Doe make this my last will and testament in manner and forme following. Item I give and bequeath my Soule into the handes of Allmighty God the father Sonn and holy Ghost; in full assurance to have it placed amongst his blessed Saints and holy Angells onely by his merittes and blood shedding of my lord and onely Saviour Jesus Christ and my body I will to be buried in the Church of Pottersperie And with touching my worldly goodes which the Lord for a tyme hath lent me I give and bequeath as followeth; Item I give and bequeath to my eldest sonne William Scrivener my messuage or tenement in Yardley gobion wherein I now dwell with the arrable landes Leys meadowe ground and Inclosure belonging to the same, And also Seaven acres of arrable land and Leie ground by me lately purchased of Edward Scrivener of Pottersperie with all the deedes Copies and writings belongin to the same To hold to my said sonne William Scrivener and to his heirs lawfully begotten of his body male or female for ever, but for a want of such heires lawfully begotten of his body male or female then to come to my sonne Richard Scrivener and his heires lawfully begotten of his body male or female for ever; Provided allwaies and my will is that in consideracon of that my guift and grant my said sonne William Scrivener shall pay out of this land which I have given him the somme of Three score pounds to three of my daughteres which I doe give them for their Legacies, and namely to my daughter Jane Scrivener the somme of Twenty pounds to be paid unto her or her Executors administrators or assignes by my sonne William Scrivener or his assignes within six months after my decease, And likewise to my daughter Margarett Scrivener the like somme of Twenty pounds to be paid unto her or to her Executors administrators or assignes by my sonne William Scrivener within Six months after my decease, And likewise to my daughter Mary Scrivener the somme of Twenty pounds to be paid unto her or to her Executors administrators or assignes by my said sonne William Scrivener within six months after my decease, And further my will is that my said sonne William Scrivener shall pay to Ann Scrivener my wiefe out of this bequeathed land, which I have given him the yearly summe of Foure poundes during her naturall liefe, which I doe give to her towards her maigntenance to be paid unto her quarterly for I doe allowe her noe thirdes out of my land, that is to saie within three months after my decease Twenty shillinges and for everie three months the like somme of Twenty shillinges to be paid unto her by my sonne William or his assigns dureing her naturall life, and likewise I doe give unto the said Ann Scrivener my wiefe all the Linnen Cloth in and about the house, and the midle Chamber to Lodge in, and the bedd which standeth therein and all things thereunto belonging; and the Chest which standeth at the bedsfeete and the Cubert and presse in the Hall, ye warming pann the postnett, two platters, three porringers, six spoones, and free libertie in the house and yard and at the fires to doe her necessary busines without Controlment during her naturall liefe; And if it happen that my said sonne William Scrivener shall depart this liefe leaving noe issue lawfully begotten of his body male nor female as aforesaid and that this land which I have bequeathed unto him shall of right descend unto my sonne Richard Scrivener and to his heires as aforesaid, And if it come to pass that he by dischargeing of those Legacies which I have appointed him to pay shalbe indebted when he departs this liefe, then my will and mind is that my sonne Richard Scrivener or his heires if they doe inheritt and possess the said land shall pay all those his debts Provided that they extend not to more than Forty pounds, And I doe give and bequeath unto my sonne Richard Scrivener twenty pounds to be paid unto him his Executors or assignes forth of my movable goodes by myne Executors herein named, within twelve months after my decease, And I doe give unto my sonne in lawe William Stilton Minister Twenty shillings to be paid unto him by mine Executors within five months after my decease, And I give unto my daughter Alise Stilton his wife twenty shillings to be paid unto her by myne Executor within five months after my decease, And I give unto my grandchild Ann Stilton Five poundes to be paid unto her at eighteen yeares of her age; and I give and bequeath unto my grandchildren James Stilton, Thomas Stilton, Francis Stilton and Theophilus Stilton twenty shillings a peece to be paid unto them at one and twenty yeares of their agee and I doe give and bequeath more unto my daughter Mary Scrivener Five poundes to be paid unto her by myne Executors forth of my moveable goodes within six months after my decease and my will is that myne Executors shall spend Forty shillings at my funeral uppon the poore and other my friends, And my will is that my sonne William Scrivener shall have all the moundes in and about the yard that and the hovell postes and Rafters the Scaffold the railes mangers plankes Cowes stalles plow timber and Cart timber which is cutt out which I doe give him for satisfaction of Six pounds which I doe owe him And I give unto my daughter Ann Smith alias Caves twenty shillinges; And I give unto my Grandchild Robert Smith alias Caves twenty shillinges, And I doe give unto my three daughters Jane, Margarett and Mary two Cartes load of fire wood cut of my yard to be delivered unto them by myne Executors presently after my decease, and my will is that all my moveable goodes which is within my dwelling house unbequeathed as namely pewter brass bedding bedsteades Coffers tables stooles Chairs barrelles tubs and all other implementes of howsehold stuff which is within doores shalbe equally distributed amongst five of my children which are unmarried , as namely William, Richard, Jane, Margarett and Mary, And all the residue of my moveable goods as namely my house bease and all other Cattell Cropp of Corne and graine of all sortes and hay, plowes Cartes and wheeles Harrowes and all other implementes of husbandrie of my moveable goods not heretofore bequeathed And all such tithes of grain and hay which are due unto me by former bargaine with Mr Carke and Thomas Smith alias Caves and all debts and somes of money which are due unto me (Except the Sawed timber; I doe give and bequeath unto my two sonns William Scrivener and Richard Scrivener, whom I doe make sole Executors of this my last will and testament Provided allwayes that they shall pay all my debtes and legacies in such manner as I have appointed in this my last will and testament, And I doe desire my sonne in lawe Robert Smith alias Caves and my loving friend Thomas Smith alias Caves the younger of Yardley gobion to be Overseers of this my last will and testament desiring them to take some payment and care in setting all things right in the behalfe of my wiefe and Children according to my meaning expressed in this my last will and testament, And I doe give themfor their paines five shilliangs a peece; And I doe renounce and disanull all other wills by me formerly made; In witness whereof I have hereunto sett my hand and seal the first day of Aprill in the yeare of our Lord God One thousand six hundred fifty and seaven Sealed and delivered to the use of the Executors within named in the presence of Robert Smith, Thomas Smith

This Will was proved the twenty fifth Daie of October One thousand six hundred fifty eight before the Judges etc by the oath of Richard Scrivener the sonne and one of the Executors to whom Administration was granted he being first sworn truly to administer etc Power being likewise reserved to William Scrivener the other Executor to prove this will when he shall legally desire it
