This is the last Will and Testament of me William Marstin of Yardley Gobion in the County of Northampton Baker First I do hereby direct that all my just Debts funeral and Testamentary Expences shall be fully Paid and satisfied I Give and bequeath unto my three children Robert Dexter Marstin Jane Marstin and William Marstin All my Plate to be equally divided between them by my Executors hereinafter named I Give and bequeath unto my said Son Robert Dextor my best Watch and Bible And unto my said Son William my other Watch and also a Bible I Give devise and bequeath unto my friends Thomas Singleton of Kettering in the said County of Northampton Upholsterer and William Saunders of Yardley Gobion aforesaid Grocer their Heirs Executors and Administrators All and every my real Estate situate lying and being in Yardley Gobion aforesaid And also all my Stock in Trade Monies and Securities for Money Book Debts and all other my Personal Estate and Effects whatsoever and wheresoever not hereinbefore by me disposed of Upon Trust that they the said Thomas Singleton and William Saunders or the Survivor of them or the Heirs or Assigns of such Survivor do and shall as soon as conveniently as they in their Discretion shall think fit and necessary sell and absolutely dispose of my said real Estate and also All my Personal Estate as shall not consist of Monies and debts and not hereinbefore disposed of either by Public Sale or by Private Contract as they my said Trustees shall think fit In the best Price or Prices that can be reasonably obtained for the same and I do declare that the receipt or receipts of my said Trustees or the Survivor of them his Heirs Executors or Administrators shall be a good and Sufficient discharge and discharges to the Purchaser or Purchasers of my real Estates shall not afterwards and answerable for his her or their Purchase Money or for so much Money as in such receipt and receipts shall be acknowledged or Expressed to be received And that the Purchaser or Purchasers of the whole or any any Part of my said real Estate shall not afterwards be answerable or accountable for the Misapplication or Nonapplication of his her or their Purchase Money or in any wise implicated in the Trust of this my said Will And my Mind and Will is that they my said Trustees and the Survivor of them and the Heirs Executors or Administrators of such Survivor do and shall stand possessed of and interested in the Money to arise by such Sales as aforesaid and of and in my said Personal Estate and Effects not hereinbefore disposed of Upon Trust in the first place to Pay all my just debts and funeral and testamentary Expences and after Payment thereof Upon Trust to lay out and invest the Produce of the real Estate and also the Personal Estate not herein before disposed of in the sa.ernment [Government?] funds of Great Britain or upon real Security at Interest in the names of the said Thomas Singleton and William Saunders Upon Trust to apply the Interest Dividends and Annual Produce thereof for the support and Maintenance of my four children Sarah Ann and the said Robert Dexter Jane and William until they shall respectively attain the Age of Twenty one Years or Marriage of my said daughter and when and so soon as they shall respectively attain that Age or Marriage Upon Trust to pay and transfer the Monies to arise by such Sale as aforesaid unto and between my said four Children the said Sarah Ann Robert Dexter Jane and William equally to be divided between them share and share alike but should either of my said Children die before attaining the said Age of Twenty one years or Marriage then the share of him or her so dying to go to the Survivors in equal Proportions Provided always and I do hereby direct and declare that in Case my said Trustees shall deem it desirable In the benefit of my Children to continue my Present business it is my Will and Intent and I do hereby authorise and empower my said Trustees to Postpone the Sale of my said real and personal Estate and empower my Sister Jemima Smith Widow now living with me to carry on the same accordingly for the benefit of my said Children Provided also and I do declare and it shall and may be lawful to and for my said Trustees to deduct retain to and reimburse themselves out of the Monies which shall come to their hands by virtue of the Trusts of this my Will All loss Costs Charges Damages and Expences which they shall be put unto in or about the Execution of the Trust aforesaid And that one of them shall not be charged or chargeable for the Acts Deeds receipts or Payment of the other of them except the same shall happen by or through their or his Wilful default respectively nor shall they or either of them be charged or chargeable with any more Monies than shall actually come to their hands by virtue of this my Will and I hereby nominate and appoint the said Thomas Singleton and William Saunders Executors of this my Will and hereby revoking and making void all former Wills by me at anytime heretofore made I declare this to be my last Will and Testament In Witness whereof I the said William Marstin the Testator have to this my last Will and Testament contained in Two Sheets of Paper set my hand and Seal to each sheet thereof this twenty ninth day of August One thousand Eight hundred and thirty one
