James Nicholes 1729

In the Name of God Amen I James Nicholes of Castle Thrupp on the County of Bucks yeoman make and ordain this my last will and Testament in Manner and form following being made on the 21st March in the year of our Lord one thousand Seven Hundred and Twenty Eight Nine and in the Second year of our Soverign Lord George the Second I being in perfect Memory tho Weak in Body
Imprimis I give unto my Son William Nicholes and to his Heirs for Ever the House that I now live in with the yard and out Buildings after my Wifes Death and to any Wife I give full power to sell my land or any part or parcel there of for the Bringing up or Maintaining my family but if she can or Doth do without it or will part thereof then the Said Land or the Remaining part or parcel of the Said land (my house Excepted) After my wifes Decease then I give the Said Land or part or parcell thereof to be Equaly divided between my Children Hereafter Nominated (viz) to my Daughter Elizabeth Nicholes and Thomas Nicholes and Katherine Nicholes and Ann Nicholes and James Nicholes to them and to their Heirs for Ever but if Either of them should die before their Mother and should not have Heirs of their Body then their part or parts shall fall Equally among their Surviving Partners but if my wife Patience Nicholes doth not Remain my Widow then I order and ordain Thomas the Son of my brother John Nicholes and Mathew the Son of my Sister Katherine Adams to be Trustees (they giving a fair Account to my children when they come to age) to Execute my Will in Selling and disposing of my land towards the Maintaining of my Children and if Patience my Wife doth Remain my Widdow and untill she changes her State by marriage I give unto her all my Houses Lands good Chattles and Money Scituate Standing lying and being in the Parrishes of Hanslop and castle Thrup in the County of Bucks (she paying my Just Debts and Legacies Making her Sole Executrix of this my last Will and Testament in Witness Whereof I have set my Hand and seal the day and year above written The Mark of James Nicholes
