This is the last Will and Testament of me Thomas Nicholls of Castlethorpe in the County of Bucks ffarmer First I Give and Bequeath All and Singular my Plate Linen China Household Goods and Furniture which shall be in my Dwelling House at the time of my decease unto my dear Wife Judith Nicholls and my two sons Thomas Nicholls and William Nicholls one half part thereof to be property of my said Wife and the other half part thereof to be equally divided between my said sons And I do hereby will and direct that my said Wife shall have the priviledge of selecting and taking for her share such part of my said Plate Linen China Household Goods and Furniture as she may think proper provided the same does not exceed one half part thereof in value And as for and concerning all other my Goods Cattle Chattels Stock Ready Money Securities for Money Debts owing to me and other my personal Estate and Effects whatsoever not hereinbefore disposed of I Give and bequeath the same and every part thereof and all my Estate and Interest therein unto my two friends Thomas Kitelee of Castlethorpe aforesaid Gentleman and Joseph Kitelee of the same place Gentleman their Executors Administrators and Assigns Upon Special Trust and Confidence nevertheless that they the said Thomas Kitelee and Joseph Kitelee or the Survivor of them or the Executors or Administrators of such Survivor shall and do as soon as conveniently may be after my decease sell and convert into ready Money All such part and parts thereof as shall consist of Monies or Securities for Money and pay apply and dispose of the Monies arising from such sale or sales and to be called received and got in a aforesaid in manner hereinafter mentioned And it is my will and mind and I do hereby direct that my said Trustees and the Survivor of them or the Administrators of such Survivor shall and do by and out of the Monies to arise from the sale of or be received or got in as part of my said personal Estate as aforesaid in the first place retain to and deduct unto themselves or himself all such costs Charges and Expences as they or he shall or may suffer sustain expend or be put unto for or by reason of the Trust hereby in them reposed And in the next place shall and do pay and satisfy all my just Debts Funeral and Testamentary Expences and subject to the payment thereof shall and do pay apply and dispose of the residue of such Monies in manner hereinafter mentioned that is to say I give and bequeath unto my Wife Judith Nicholls the Legacy or Sum of One hundred pounds and unto my Nephew John Barrett of Hanslope in the County of Bucks ffarmer the legacy or sum of Twenty pounds to be paid to them respectively within [six] Months after my decease Also I Give and bequeath unto the said Thomas Kitelee and Joseph Kitelee their Executors or Administrators the sum of Five Hundred pounds In Trust nevertheless that they my said Trustees or the Survivor of them or the Executors or Administrators of such Survivor do and shall put and place the same out at Interest upon Government or Real Security as they shall in their discretion think proper and call in and replace the same out again from time to time as they or he shall see occasion And shall and do pay apply and dispose of the Interest Dividends and other yearly proceed to arise or be made from the sum of Four hundred pounds part of the said Principal sum of Five Hundred pounds as and when the same shall be received unto my dear Wife Judith Nicholls and her Assigns for and during the term of her natural life to and for her own separate and peculiar Use and benefit And also do and shall pay and apply the Interest Dividends and other yearly proceed to arise or be made from the sum of One Hundred pounds the other part of the sum of Five Hundred pounds as and when the same shall be received unto and for the use of my said son Thomas Nicholls his Executors Administrators or Assigns during the natural life of my said Wife Judith Nicholls and from and immediately after the decease of my said Wife In Trust to pay and apply and I do hereby Give and bequeath the said several sums of Four hundred pounds and One hundred pounds and all such Interest and Dividends as shall be due and unpaid in respect of the said sum of Four hundred pounds unto my said Son William Nicholls his Executors Administrators or Assigns And as to for and concerning all the rest residue and remainder of the said Monies to arise from the sale of or be received or got in as part of my said personal Estate after payment of the said Debts Costs and Expences and the said legacies of One hundred pounds twenty pounds and Five hundred pounds as before directed In Trust that they my said Trustees or the Survivor of them or the Executors or Administrators of such survivor do and shall pay and apply and divide and I do give and bequeath the same unto my said two sons Thomas Nicholls and William Nicholls their Executors administrators or assigns to be equally divided between them share and share alike And my Will and mind is and I do hereby direct that they my said Trustees or either of them or either of their Executors or administrators shall not be charged or chargeable with or accountable for any more monies of the aforesaid trust monies than they shall respectively actually receive or shall come to their respective hands by virtue of the same or any part thereof so as such loss happen of the same without their wilful neglect or default nor either of them for the other of them but each of them only for his own acts deeds receipts or disbursements Also that it shall and may be lawful for them my said Trustees and each of them their and each of their Executors And administrators by and out of the aforesaid trust Monies to deduct and reimburse themselves and himself All such loss loss Costs Charges and Expences as they or either or any of them shall or may sustain expend or be put unto for or by reason of the said several thrusts hereby in them reposed or the management and execution thereof or any other thing in any wise relating thereto And Lastly I do hereby nominate constitute and appoint the said Thomas Kitelee and Joseph Kitelee Joint Executors of this my Will And hereby revoke annul and make void all former Wills by me made In Witness whereof I have hereunto set my hand and seal this twenty second day of ffebruary in the year of our lord one thousand eight hundred and eight his mark and seal Thomas Nicholls the above writing was carefully read over to the said Testator Thomas Nicholls and approved of by him and was by him Signed sealed published and declared as and for his last will and Testament in the presence of us who at his request have signed our names as witnesses thereto Wm Gregory of Castlethorpe Jno Freer Proved the 28th day of June 1810 before the reverend Luke Heslop D.D. Archdeacon and commissary &c by the oaths of Thomas Kitelee and Joseph Kitelee the Joint Executors to whom Admon was committed they being first sworn duly to administer
