In the name of God Amen I Thomas Hackett The Fourteenth Day of September in the yeare of our Lord One thousand Six Hundred Fiftie Seaven I Roger Hacket of North Crawley in the County of Bucks Esqr doe make this my last will and Testament in manner following Imprimis I give my Eldest sonne Thomas Hacket to and for his owne use untill such time as my sonne Roger Hacket shall or may attain his Age of Twentie Foure yeares All my Lands in North Crawley Except all my Lands Spinnies and Woods in East Field with other my Lands in Richard Sheffeilds Occupation and Except Greenses Close And then ye devised lands shall goe to my sonn Roger for his Life And after his decease to his first sonne begotten or to be begotten and to the Heires of such first Sonnes Bodie And for each of such I ..ie To All and evry of the Sonne and sonnes of the Bodie of the said Roger begotten and to be begotten successively according as they shalbe in Seniority of and for the like estate tayle And for want of such Issue to the Heires of the Bodie of my sonne Roger And for default of such Issue to my eldest sonne Thomas and to Richard Hacket my youngest Sonne and the Heires of their Bodies equally to be divided. Provided alwayes and my meaning is Forasmuch as I have intended my lands and Hereditaments in Kent to my sonne Roger. The which (in Regard they are intayled) I Cannot at present dispose of according as I hav purposed My mind and will is That whensoever my sonne Thomas or his Heires shall be good and Legall Convey are settle and appure those Kentish Lands and Hereditaments according to the fore specified Estates Lymitacous of the above bequeathed Lands in North Crawley with power moreove to my sonne Roger to make a Jointure in the same manner as is hereafter by me desired in this my will Then the aforesaid bequeath of All the bequeathed Lands in North Crawley shalbe voyd to All intents and purposes as if no such had ever Give Item I give my Lands in Hanslopp in the County of Bucks and also All my Lands now in Richard Sheffeilds occupation in North Crawley unto my Sonne Thomas to and for his owne use untill such Time as my Sonne Richard Harket shall or may attain his Age of Twentie Fower yeares And then my Sonne Nicholas shall have them for his Life And after his decease then shalbe and Remaine to his first begotten or to be begotten Sonne and the Heires of his Bodie And for default of such Issue to all and every other Sonne and Sonnes of the said Nicholas as begotten and to be begotten successively according to their Seniority of and for the Like Estate Tayle And for want of such Issue to the Heires of the Bodie of the said Nichols And for want of such Issue they shall Remainie over to my Sonnes Thomas and Roger and the Heires of their Bodies in equall Division betwixt them And in default of such Issue to my owne Right Heires Provided and my meaning is That if my Executors or my Heir or Heires shall within Seaven yeares after my death pay to my Sonne Nicholas Eight Hundred pounds or settle or Tender a Settlement upon him by the estate for his Life with the Remainder and Remainders over in like manner as is above Limited of the Land above bequeathed to him Lands Tenements or Hereditaments in the Counties of Bucks Bedford and Northampton or in any of them of the Clear Yearlie value of Fortie pounds per Annum Then this devise as to my lands in Sheffeilds Occupation shalbe void: Item I give to my sonne Roger Threescore pounds per And a Annuitie And to my sonn Nicholas as Annuity of Fortie pounds to each of them Respectively untill he shall accomplish his Age of Twentie Foure yeares To be payd by my Executor by equall Quarterly payment The first payment of each Annuity to be upon the Tenth Day next after my death and so onward quarterly The place of payment to be my sonne Thomas his now Dwelling House Item my mind is that if the Fowre Overseers of this my Last will and Testament hereafter named or any Three of them or In Case any one of them dye any two of the Survivors shall by writing under their Hands and Seales in ye presence of Three Witnesses determine and Signifie to my Heire or Heires for the Time being their Judgement and pleasure to be that the Lands Tenements and Hereditament above bequeathed to my Sonnes Robert and Nicholas as abovesaid shall Come to either of their Respective possession sooner then is in this my will above appointed Then the same with and upon the Conditions above annexed
to the shutes? Shall Come and be accordingly And all remainders above Limited of those Lands shall have their dependence there upon So as the possessions respectively be not determined to come before their Respective Ages of Twentie One yeares And then also upon the coming of such possession the Annuities above bequeathed shall cease respectively And then moreover my sonne Thomas and his Heires shall have out of my Sonne Rogers Lands Fortie pounds per annum And out of my sonne Nichols his Lands Threescore pounds And untill the deaths of the said Roger and Richard respectively attaining Twentie Fowr yeares of Age which soever of the accidents of age or death each by even porcons And first payment of each respectively to be at such of the said Feasts as shall incurr next after heir coming to possession of their Respective Lands And my sonne Thomas and his Heires shall have Liberty to distraine for the Arrearages in the Liable Lands Respectively And further my will is tHat my sonne Roger being in possession of the Landes to him bequeathed may by writing under his hand and Seale or by his Last will in writing Lymit an estate in Jonicture [Jointure] to any woman or Women being hids wife or wives or whom he shall intend to take to wife in any part in specie of the Lands and Hereditament above bequeathed to him not exceeding One Hundred mark vas per annid And my will is that such woman and Women shall have estates accordingly Soeas the estate in Jointure be not to Continue Longer than ye jonitresse Life nor to take effect after Condition? of the Coverture And I desire my sonne Thomas and his Heire upon their Settlement of the Kentish Lands upon my sonne Roger to give him the like power of making Jointures and with ye like qualification and Condition The which power as to the Kentish Lands being granted to my sonne Roger my will is that All Jointures and incumbrances happening to be under by him in the Lands shall cease and be void And moreover I will That mu Sonne Nicholas having attained possession of the Lands in Hanslop mya by writing under his Hand and Seal or by his Last will in writing Lymit and appoint any woman or women being his wife or wives or whom he shall purpose to take in marriage any estate in jointure therein or in any part thereof: And my will is such woman and Women shall have estates according to such Limitation So as the estate in Jointure be not Limited to Commence before the Coverture nor to continue longer than the jointress life. Item If my Sonne Roger shall have Two Children both of them being in Life at the same Time and the Youngest of them being a Year old I give to that Youngest Two Hundred and Fifty pounds at its Age And if he happen to have Three Children all of them being alive at oure and the youngest of them being one years yeare old I give to That youngest Two Hundred and Fiftie pounds at its said Age Item if my sonne Nicholas shall have Two Children both of them being in Life together and the youngest of them being of the age of One yeare that youngest at its said age shall have Two Hundred and Fiftie pounds And if he happen to have Three and all of them to continue in Life together the youngest of them being one yeare old Then I give to that youngest Two Hundred and Fiftie pounds at its said age All the said summes to payd to the Hands of the said Nichols and Roger for the use of their said Children Legatees respectively by mine Executor Item of this my last will and Testament I make my eldest sonne Thomas Harket sole Executor To whom I hereby give all my goods and Chattles Rights Debts and Credits not formerly herein bequeathed And also All Bonds Bills Mortgages and specialties whereby any debt right or Credit is due or seased to me or to any other in Trust for me or to my use And I doe hereby Revoke All former wills heretofore made And lastlie I doe desire my loving Brothers in law Humpfrey Monox and Mathew Dentengent and my Cozen Robt Hungerford of Grayes Inne Esqr and Andrew William Clarke Rector of North Crawley Church to be Overseers of this my will and Testament In case my Bonds Speciallties or Mortgages betaken in any other name then my own yet I bequeath them solely to my sonne Tho: my Executor And if any of them shall happen to be taken in the names of my Sonnes Roger Nicholas and they not ass.l and suffer my Executor in the Receiving and Recovery of them to his own use Then my will is that my legacies within bequeathed to their second and Third Children shalbe voyd In witnece that is my last will and Testament I set my Hand the day and yeare first above written which will is Conteyned in Eight Sheets of paper
This will was proved at London The One and Twentieth day of December in the yeare One Thousand Six Hundred Fifty Seaven Before the Judges for probat of wills and granting Administrations Lawfully authorized By the oath of Thomas Hacket the sonne and sole Executor named therein To whom was granted Administration of all and singuler the goods Chattles and Debts of the said deceased He being by Commission first sworn truly to Administer As also Roger and Nicholas Harket and William Clarke Witnesses by virtue of the same Commission were sworne to the Truthof the said will
