William Fisher 1822
This is the last will and testament of me William Fisher of North Crawley in the County of Bucks Yeoman Which I make in manner following that is to say First I give and bequeath unto my wife Sarah Fisher absolutely to be at her own disposal two beds with the furniture thereto belonging and such and so many other articles of household furniture linen china and plate as will be sufficient to furnish her a small cottage Next I give devise and bequeath unto my friends Richard Wilmer of Loughton in the County of Bucks Yeoman George Rock of Woburn in the County of Bedford Yeoman and his brother Samuel Rock of Cranfield in the said county of Bedford Yeoman All and singular my messages cottages lands tenements hereditaments and real estate whatsoever at North Crawley aforesaid with their and every of their appurtenances And also all the residue of my household furniture linen china plate and all my stock goods chattels cattle and personal estate and effects whatsoever and wheresoever To hold my said real and personal estates and effects unto the said Richard Wilmer George Rock and Samuel Rock their heirs executor and administrators upon special trust and confidence that they my said trustees their heirs executors and administrators You and shall with all convenient speed after my decease either together or private contract as they in their discretion shall think proper And do and by public auction make sale and dispose of or the said residue of my household furniture linen china and plate and also all my stock goods chattels and personal estate and effects whatsoever and wheresoever and do and shall collect get in and receive all debts due and owing to me at the time of my decease and after such sale and collection of debts as aforesaid and the payment of all costs charges and expenses in and about the proof of this my Will and the trusts hereof do and shall by and with the residue of the money pay the following legacies to my children that is to say my son John Fisher one hundred and fifty pounds to my son Thomas Fisher three hundred pounds to my son James Fisher three hundred pounds to my son George Fisher six hundred pounds and to my son Samuel Fisher four hundred and fifty pounds to my daughter Mary Fisher five hundred to my daughter Sophia Fisher Four hundred and seventy pounds And I direct that my said trustees or the survivor of them or the executors or administrators of such survivor will put out and place out in their or his joint names or name in the public funds or on such other security as they approve three hundred pounds and …… and pay the dividends thereof into the proper hands of my daughter Ann the wife of William Redden for and during the time of her natural life separate and altogether apart from her husband and in …. or with which I direct he shall have not debts or engagements and that her receipt alone for such dividends and interest shall notwithstanding her coverture from time to time be a good and sufficient discharge and discharges to my said trustees and from immediately after the decease of my said daughter Ann Redden I give and bequeath the said principal sum of three hundred pounds unto and amongst her lawful issues at the time of her decease if more than one equally share and share alike and if by one then to such one child all which legacies above mentioned I will and direct shall be paid or retained within twelve months next after my decease but if the monies to arise and be made by the ways and means aforesaid will not be sufficient to pay the said legacies in full then I will and direct that each legatee shall abate in Propoction to the amount of his or her legacy respectively and on the other hand there shall be any surplus after Payment of the said legacies in full then and in such case I give and bequeath all such surplus unto amongst and between all my sons William Thomas James John George and Samuel or such of them as shall be then living equally share and share alike And I do hereby appoint the said Richard Wilmer George Rock and Samuel Rock joint executors of this my last Will and Testament and for facilitating the sale of my said real estate I do hereby will direct and declare that the receipt of my said trustees or the survivor of them or the heirs of such survivor shall from time to time be good and sufficient discharges to the purchaser or purchasers of my said real estate or any part or parts thereof for so much money as in such receipt or receipts shall be expressed to be received and that
after the signing of such receipt or receipts by my said trustees or the survivors or survivor of them or the heirs or assigns of such survivor such Purchaser or Purchasers shall be absolutely discharged therefrom and shall not afterwards be obliged to see to the application of the said Purchase money or be Answerable or accountable for the nonapplication thereof or of any part thereof and I do hereby declare that my said trustees shall be at full liberty to deduct retain to and reimburse themselves out of the trust monies all cast charges and expences which they may be put unto in the execution of the trusts hereby in them reposed vested and that they or either of them shall not be answerable or accountable for any more of the said trust money than what they shall respectively actually receive nor be answerable or accountable for any involuntary loss or losses thereof but such only as shall happen through his or their wilful neglect or default and lastly I do hereby revoke and make void all former Wills by me made and declare this only to be my last Will and Testament In Witness hereof I the said William Fisher the Testator have to this my last Will and Testament contained in three sheets of Paper fixed together at the top with a seal set my hand and seal that is to say to the two first sheets hereof my hand only and to this third and last sheet my hand and seal this sixteenth day of September in the year of our Lord One thousand eight hundred and fourteen Wm Fisher Signed sealed published and declared by the said William Fisher the Testator as and for his last Will and Testament in the Presence of who at his request and in the presence have attested the same in the presence of each other the word “Richard” in the name “Richard Wilmer” the Will throughout and the word “three” in the nineth line from the top of the first sheet being first written erazures [erasures] the coocde “their heirs oeeutore and administrators” between the sixteenth and seventeenth lines from the top of the first sheet being first interlined and the word “September” in the last sheet being first written over the word July Wm Brewer George Cooch Geo Cooch Junr
Whereas I William Fisher of North Crawley in the County of Buckingham Yeoman have dully made and published my last Will and Testament bearing date the sixteenth day of September in the year of our Lord One thousand eight hundred and fourteen Now I do hereby declare this present writing to be a Codicil to my said Will and I do direct the same to be taken as part thereof And whereas I have in and by my said Will amongst other legacies directed my trustees therein named to pay by and with the residue of the money to be raised by the sale of my real and personal estate by collecting in my debts a legacy of four hundred and seventy pounds to my daughter Sophia who is in and by my said will described as Sophia Fisher but whose name was at the time of Publishing said Will and still is Sophia Holloway the wife of John Holloway Now I do hereby ratify and confirm the said legacy to be paid to my said daughter Sophia my meaning here being to correct the error in my said writed Will as to the description of my said daughter Sophia and whereas by way of security for the sum of sixty pounds raised by my son Samuel Fisher I have joined with him in a promissory note bearing date on or about the 14th day of July 1815 whereby not jointly and separately promise to pay Mr George Rock or his order on demand sixty pounds Now I hereby oneea? to and charge all my real personal estate of and with the Payment of the said sum of sixty pounds all interest which may at the time of my decease be due thereon which said sum of sixty pounds and interest which may be due on the said promissory note I desire to be considered as a legacy to my said son Samuel FisherAnd as security for the sum of four hundred and twenty pounds raised by my son William Fisher I have joined with him in a Promissory note dated on or about the 15th November 1820 whereby we jointly and severally Promise to pay Mr George Rock or his order or demand four hundred and twenty pounds with lawful interest I do hereby onerate and charge all my real and Personal estate of and with the payment of the said sum of four hundred and twenty pounds and all interest which may at the time of my decease be due thereon And which said sum of four hundred and twenty pounds and all interest which may due thereon is to be considered as a legacy to my said son William Fisherand from and out of the money to be raised by sale of my real and personal estate and collection of my debts as in my said Will directed I do hereby direct my said trustees to pay discharge all my just debts and funeral and testamentary expences And lastly I do hereby in all other respects ratify and confirm my said Will In Witness whereof I the said William Fisher the Testator have to this my Codicil contained in two sheets of paper to the first sheet thereof set my hand and to this second and last sheet my hand and seal this first day of March in the year of our Lord one thousand eight hundred and twenty two Wm Fisher Signed sealed Published and declared by the said William Fisher the testator as and for a Codicil to the last Will and Testament in the presence of us who in his presence at his request and in the presences of each other have hereunto subscribed our names as Elizabeth Brewer Caroline Brewer North Crawley Wm Harland Clark to W.
