11. Indenture dated 1 October 1787 Doc Ref: odhs032

This indenture made the first day of October in the twenty seventh year of the reign of our soverign Lord George the third by the grace of God of Great Britain

France and Ireland King defender of the faith and so forth and in the year of our Lord one thousand seven hundred and eighty seven between

Thomas Wheatley of Olney in the county of Bucks yeoman of the one part and Richard Chater of Olney aforesaid butcher of the other part

witnesseth that for and in consideration of the sum of one hundred and twenty pounds of good and lawful money of Great Britain to the said Thomas

Wheatley in hand at or before the sealing and delivery of the presents well and truly paid by the said Richard Chater the receipt whereof he the said Thomas Wheatley doth hereby

acknowledged and thereof and of every part and parcel hereof doth hereby acquit exonerate and forever discharge the said Richard Chater his heirs executors administrators and every of

them by these presents he the said Thomas Wheatley hath granted bargained sold aligned enfeoffed released and confirmed and by these presents doth fully clearly and absolutely

grant bargain sell alien enfeoffed release and confirm unto the said Richard Chater his heirs and assigns forever  all that cottage or tenement with the yard or orchard and hereditaments

thereunto belonging situate and being in Olney aforesaid and in the tenure or occupation of William Finedon his undertenants or assigns the house and grounds of Brightman

Andrews lying and being on the south side and the house and grounds of Mark Harrison and Widow Allsop on the north side thereof fronting the common street in Olney aforesaid

on the west part thereof together with all houses edifices buildings orchards gardens banksides hedges ditches trees fences wood underwood common of

pastures profits commodities hereditaments appurtenances whatsoever to the aforesaid cottage or tenements and premises or any or either of them or in anywise

appertaining or accepted reputed taken or known as part and parcel or member of the same or of any part thereof and the reversion and reversions remainder and remainders rents issues

and yearly and other profits of all and singular the same cottage or tenement and premises and also all the estate right with interest use possession profit property claim demand

whatsoever both in law and equity or otherwise howsoever of him the said Thomas Wheatley of in and to the same cottage or tenement yard or orchard or any part thereof together with

all deeds evidence and writings whatsoever touching or in anywise concerning the aforesaid cottage or tenement yard or orchard or any part thereof to have and to hold the aforesaid

cottage or tenement yard or orchard and all and singular other the premises have by granted bargained sold alined enfeoffed released and confirmed or meant or mentioned or and confirmed or meant mentioned or

so intended so to be with their and every of their appurtenances and every part and parcel thereof unto Richard Chater his heirs and assigns to and for the sole only

proper use and behoof of him he said Richard Chater his heirs and assigns forever and to and for none other use intent or purpose whatsoever and the said Thomas

Wheatley doth hereby for himself his heirs executors administrators and assigns and for every of them covenant promise grant and agree to and with the said Richard Chater

his heirs and assigns and to and with every of these presents in manner following that is to say that for and not withstanding any act matter deed or thing whatsoever

by him the said Thomas Wheatley committed done or suffered to the contrary by the said Thomas Wheatley now is and standeth lawfully rightfully solely and

absolutely seized and in all and singular the aforesaid cottage or tenement yard or orchard hereby granted and released or meant mentioned or intended so to be with their

and every of their appurtenances of and in a good sure perfect and indefeasible estate of inheritance in fee simple in possession without any manner of condition

limitation use trust and power of revocation or any other matter causes or thing whatsoever whereby to alter change revoke or determine the same and also

that the said Thomas Wheatley now hath in himself good rightful power and lawful and absolute authority to grant assure release and convey the aforesaid cottage or

tenement with the appurtenances  unto the said Richard Chater his heirs and assigns according to the true intent and meaning of these presents and also that the said

Richard Chater his heirs and assigns shall and may from time to time and at all times hereafter lawfully peaceably and quietly have hold use occupy possess and enjoy all

and singular the aforesaid premises hereby granted and released or meant mentioned or intended so to be and every part and parcel thereof with their and every of their

appurtenances without the lawful suit trouble interruption or denial of or by him the said Thomas Wheatley his heirs and assigns or by any  other person or persons

whatsoever lawfully claiming or to claim by from or under him them or either of them freed acquit and discharge of and from all other estates titles troubles

charges and incumberants whatsoever and further that he the said Thomas Wheatley his heirs and assigns and all and every other person or persons

lawfully claiming or to claim by from or under him them or either or any  of them shall and will at all times hereafter upon the reasonable request and at the proper

cost and charges in the law

of the said Richard Chater his heirs and assigns do make acknowledge levy suffer finish and execute or cause to procure to be done made

acknowledge levied suffered finished and executed all and every such further and other lawful and reasonable act or acts thing or things devise and

devices conveyances and assurances in the law whatsoever for and further better more perfect and absolute assuring and confirming of all and singular the aforesaid

premises hereby granted and released or meant mentioned or intended so to be with their appurtenances unto the said Richard Chater his heirs and assigns or unto such

other person or persons as he or they shall direct or appoint be the same by fine or fines deed or deeds enrolled or not enrolled or otherwise howsoever as by the said Richard

Chater his heirs or assigns or his or their counsel learned in law shall be reasonably devised advised or required all which said further assurance and assurances so or in any

other way or manner to be had and levied and all and every other fine  or fines and assurances here to fore had and levied or have after to be had and levied by and between the said

parties to these presents or any of them and concerning the said cottage or tenement and premises hereby granted and released shall be and enure and is and are hereby and

by all the said parties to these presents declared and agreed to be and inure to and for the sole only proper use and behoof of him the said Richard Chater his heirs and

assigns forever and to and for none other use intent or purpose whatsoever in witness whereof the said party first above to these presents have hereunto set his

hand and seal the day and year first above written.
