12. Indenture dated 4 April 1789, Doc Ref: odhs036

This indenture made the fourth day of April in the twenty ninth year of the reign of our sovereign Lord George the third by the grace of

God of Great Britain and France and Ireland King defender of the faith and so forth and in the year of our Lord one thousand

seven hundred and eighty nine between Richard Chater of Olney in the county of Bucks butcher of the one part and

Ann Robinson of Warrington in the said county of Bucks widow of the other part witnesseth that for and in or

consideration of the sum of one hundred and ten pounds of lawfull money of Great Britain to him the said Richard Chater

doth hereby acknowledge and thereof and of every part thereof doth acquit exonerate and forever discharge the said Ann Robinson her heirs executors

and administrators and every of them by these presents he the said Richard Chater hath granted bargained sold aliened released enfeoffed and confirmed

and by these presents doth doth grant bargain sell alien release enfeoffed and confirm unto the said Ann Robinson her heirs and assigns all that cottage or

tenement with the yard or orchard thereunto belonging situate and being in Olney aforesaid late in the tenure or occupation of William Finedon and now of the said Ann Robinson her undertenants or assigns the house and grounds of Brightman Andrews being on the south side thereof the house and ground

of Mary Harrison and widow Alsop being on the north side thereof and fronting the common street in Olney aforesaid on the west side thereof which

said premises were lately purchased by the said Richard Chater of Thomas Wheatley together with all houses outhouses edifices buildings barns

stables yards gardens orchards banksides hedges ditches trees mounds fences ways waters paths passages commons and common pasture profits privileges

advantages emoluments hereditaments and appurtenances whatsoever the said premises belonging or in any wise appertaining or accepted reputed deemed taken

or known as part parcel or member thereof or as belonging thereunto and the reversion and reversions remainder and remainders *** and profits

thereof and all the estate right title interest use trust possession property benefit claim and demand whatsoever both at law and in equity of him the

said Richard Chater of into or out of the said premises and every part thereof and all deeds evidences and writings whatsoever relating to or in any wise

concerning the same premises now in the hands custody or power of him the said Richard Chater or which he can obtain without suit at law or in

equity. To have and to hold the said cottage or tenement yard or orchard and all the singular other premises herein before mentioned and intended

to be hereby granted and enfeoffed with their and every of their appurtenances unto the said Anne Robinson her heirs and assigns to the only proper use and

behoof of the said Ann Robinson her heirs and assigns forever and to and for no other use intent or purpose whatsoever and the said Richard Chater

for himself his heirs executors and administrators doth covenant promise and declare to and with the said Ann Robinson his heirs and assigns

by these presents in manner following (that is to say) that for and notwithstanding any act deed matter or thing whatsoever by him the said Richard Chater made done or suffered to contrary the said Richard

Chater at the time of sealing and delivering these presents is and standeth lawfully rightfully and absolutely seized of and in the said cottage or tenement

yard or orchard hereditaments and premises above mentioned and intended to be hereby granted and enfeoffed of and in a good sure perfect absolute and

indefeazable estate of inheritance in fee simple in possession without and manner of condition promise restraint matter or thing whatsoever to defeat change

charge revoke alter or determine the same and that and not withstanding and such act matter or thing aforesaid he the said Richard Chater

hath in himself good right full power and lawful and absolute title and authority to grant enfeoff and convey the said cottage or tenement yard of orchard

hereditaments and premises above mentioned and intended to be hereby granted and enfeoffed with the appurtenances unto the said Ann Robinson he

heirs and assigns in manner and form aforesaid according to the intent and meaning of these presents and she the aforesaid Ann Robinson

shall and may from time to time and at all times hereafter peaceably and quietly enter into and upon have had use occupy possess and

enjoy the said hereditaments and premises hereby granted and enfeoffed or mentioned and intended so to be with the appurtenances and receive and

take rents *** and profits thereof to and for her own use and benefit without any the lawful let suit trouble denial eviction

ejection disturbance or other hinderance or molestation whatsoever of or by him the said Richard Chater his heirs or assigns or of or by any other

person or persons whatsoever claiming or to claim any estate right title or interest in the said premises by from or under him or them

and that free and clear and freely and clearly acquitted exonerated and discharged or otherwise well and sufficiently saved defended kept harmless and

indemnified of from and against all and all manner of former and other gifts grants bargains sales leases mortgages settlements uses wills entails

*** and thirds rents and arrears of rent bands statutes judgements recognizances executions extracts estate titles troubles charges and incumbrances

whatsoever had made done committed or wittingly or willingly suffered by him the said Richard Chater or by or through his acts

defaults or procurements and further that he the said Richard Chater and his heirs and all and every other person or persons having or

lawfully claiming or who shall or may have or lawfully claim any estate right title or interest of into or out of the said premise above mentioned and

intended to be hereby granted and enfeoffed or any part thereof by from or under him or them shall and will from time to time and at all times hereafter upon every

reasonable request and at the proper costs and charges in the law of the said Ann Robinson her heirs or assigns make do acknowledge levy suffer and execute or cause

or procure to be made done acknowledged levied suffered and executed all and every such further and other lawful and reasonable acts deeds fines recoveries conveyances

and assurances in the law whatsoever for the further more perfect and absolute granting conveying and assuring the said cottage or tenement yard or orchard hereditaments

and premises above mentioned and intended to be hereby granted and enfeoffed with the appurtenances unto the said Ann Robinson her heirs and assigns as by the said Ann Robinson

her heirs or assigns or her or their counsel learned in the law shall be reasonably devised or advised and required in witness whereof the said parties to these presents have hereunto set their hands and seals the day and year  first  above written.
